5	5	relating to the medical transportation and care for certain inmates
6	6	in the Texas Department of Criminal Justice.
7	7	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	8	SECTION 1. Subchapter B, Chapter 501, Government Code, is
9	9	amended by adding Sections 501.0515 and 501.071 to read as follows:
10	10	Sec. 501.0515. PROCEDURES FOR TRANSPORTATION OF FEMALE
11	11	INMATES FOR MEDICAL CARE. The department shall establish
12	12	procedures to be used during the regularly scheduled transportation
13	13	of female inmates for nonemergency medical care to The University
14	14	of Texas Medical Branch at Galveston or another medical facility
15	15	that provides medical services for inmates. The procedures must
16	16	ensure that:
17	17	(1) any searches conducted are performed in an area
18	18	and manner that conforms with the requirements of the Prison Rape
19	19	Elimination Act of 2003 (34 U.S.C. Section 30301 et seq.) and any
20	20	regulation adopted under that Act;
21	21	(2) buses used to transport female inmates are
22	22	equipped with bathrooms and have an adequate supply of toilet paper
23	23	and feminine hygiene products as defined by Section 501.0675 for
24	24	the inmates being transported;
25	25	(3) female inmates receive sufficient food and
26	26	nutrition in accordance with medical or nutritional standards as
27	27	determined by the department; and
28	28	(4) facilities used to house female inmates overnight
29	29	while being transported have an adequate number of beds for the
30	30	inmates being transported.
31	31	Sec. 501.071. ACCESS TO TELEMEDICINE AND TELEHEALTH
32	32	SERVICES AND ON-SITE MEDICAL CARE. The department, in conjunction
33	33	with The University of Texas Medical Branch at Galveston and the
34	34	Texas Tech University Health Sciences Center, shall establish
35	35	procedures to increase opportunities and expand access to
36	36	telemedicine medical services and telehealth services, as those
37	37	terms are defined by Section 111.001, Occupations Code, and on-site
38	38	medical care for inmates, including on-site mobile care units that
39	39	provide diagnostic imaging, physical therapy, and other
40	40	appropriate mobile health services.
41	41	SECTION 2. Not later than December 1, 2023, the Texas
42	42	Department of Criminal Justice shall establish the procedures
43	43	required by Sections 501.0515 and 501.071, Government Code, as
44	44	added by this Act.
45	45	SECTION 3. Not later than December 1, 2024, the Texas
46	46	Department of Criminal Justice shall submit a report to the
47	47	legislature on the department's progress in increasing
48	48	opportunities and expanding access to telemedicine medical
49	49	services and telehealth services and on-site medical care for
50	50	inmates under Section 501.071, Government Code, as added by this
51	51	Act, including a summary of the procedures established under that
52	52	section and the number of inmates who received services or care
53	53	under those procedures.
54	54	SECTION 4. This Act takes effect September 1, 2023.
