55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to accelerated instruction for public school students who
88 fail to achieve satisfactory performance on certain assessment
99 instruments.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Sections 28.0211(a-4) and (a-6), Education Code,
1212 are amended to read as follows:
1313 (a-4) If a district receives funding under Section 29.0881,
1414 the Coronavirus Response and Relief Supplemental Appropriations
1515 Act, 2021 (Div. M, Pub. L. No. 116-260), or the American Rescue Plan
1616 Act of 2021 (Pub. L. No. 117-2), then supplemental instruction
1717 provided by a school district under Subsection (a-1)(2) must:
1818 (1) include targeted instruction in the essential
1919 knowledge and skills for the applicable grade levels and subject
2020 area;
2121 (2) be provided in addition to instruction normally
2222 provided to students in the grade level in which the student is
2323 enrolled;
2424 (3) be provided:
2525 (A) for 10 [no less than 30] total hours, or more
2626 hours if recommended by the school district and authorized by the
2727 student's parent or guardian;
2828 (B) during the subsequent summer or school year;
2929 and
3030 (C) according to a schedule the district
3131 determines is most effective for the student [, unless the
3232 instruction is provided fully during summer, include instruction no
3333 less than once per week during the school year];
3434 (4) be designed to assist the student in achieving
3535 satisfactory performance in the applicable grade level and subject
3636 area;
3737 (5) include effective instructional materials
3838 designed for supplemental instruction;
3939 (6) be provided to a student individually or in a group
4040 of no more than six [three] students, unless the parent or guardian
4141 of each student in the group authorizes a larger group;
4242 (7) be provided by a person with training in the
4343 applicable instructional materials for the supplemental
4444 instruction and under the oversight of the school district; and
4545 (8) to the extent possible, be provided by one person
4646 for the entirety of the student's supplemental instruction period.
4747 (a-6) The commissioner shall:
4848 (1) provide guidelines to school districts on
4949 research-based best practices and effective strategies that a
5050 district may use in developing an accelerated instruction program;
5151 (2) [and shall] provide resources to districts to
5252 assist in the provision of an accelerated instruction program; and
5353 (3) provide information to districts before the
5454 beginning of each semester on effective uses for each resource
5555 provided under Subdivision (2).
5656 SECTION 2. This Act applies beginning with the 2023-2024
5757 school year.
5858 SECTION 3. This Act takes effect immediately if it receives
5959 a vote of two-thirds of all the members elected to each house, as
6060 provided by Section 39, Article III, Texas Constitution. If this
6161 Act does not receive the vote necessary for immediate effect, this
6262 Act takes effect September 1, 2023.
