7 | 7 | | relating to accelerated instruction for public school students who |

8 | 8 | | fail to achieve satisfactory performance on certain assessment |
---|
9 | 9 | | instruments. |

10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Sections 28.0211(a-4) and (a-6), Education Code, |
---|
12 | 12 | | are amended to read as follows: |
---|
13 | 13 | | (a-4) If a district receives funding under Section 29.0881, |
---|
14 | 14 | | the Coronavirus Response and Relief Supplemental Appropriations |
---|
15 | 15 | | Act, 2021 (Div. M, Pub. L. No. 116-260), or the American Rescue Plan |
---|
16 | 16 | | Act of 2021 (Pub. L. No. 117-2), then supplemental instruction |
---|
17 | 17 | | provided by a school district under Subsection (a-1)(2) must: |
---|
18 | 18 | | (1) include targeted instruction in the essential |
---|
19 | 19 | | knowledge and skills for the applicable grade levels and subject |
---|
20 | 20 | | area; |
---|
21 | 21 | | (2) be provided in addition to instruction normally |
---|
22 | 22 | | provided to students in the grade level in which the student is |
---|
23 | 23 | | enrolled; |
---|
24 | 24 | | (3) be provided: |
---|
25 | 25 | | (A) for 10 [no less than 30] total hours, or more |
---|
26 | 26 | | hours if recommended by the school district and authorized by the |
---|
27 | 27 | | student's parent or guardian; |
---|
28 | 28 | | (B) during the subsequent summer or school year; |
---|
29 | 29 | | and |
---|
30 | 30 | | (C) according to a schedule the district |
---|
31 | 31 | | determines is most effective for the student [, unless the |
---|
32 | 32 | | instruction is provided fully during summer, include instruction no |
---|
33 | 33 | | less than once per week during the school year]; |
---|
34 | 34 | | (4) be designed to assist the student in achieving |
---|
35 | 35 | | satisfactory performance in the applicable grade level and subject |
---|
36 | 36 | | area; |
---|
37 | 37 | | (5) include effective instructional materials |
---|
38 | 38 | | designed for supplemental instruction; |
---|
39 | 39 | | (6) be provided to a student individually or in a group |
---|
40 | 40 | | of no more than six [three] students, unless the parent or guardian |
---|
41 | 41 | | of each student in the group authorizes a larger group; |
---|
42 | 42 | | (7) be provided by a person with training in the |
---|
43 | 43 | | applicable instructional materials for the supplemental |
---|
44 | 44 | | instruction and under the oversight of the school district; and |
---|
45 | 45 | | (8) to the extent possible, be provided by one person |
---|
46 | 46 | | for the entirety of the student's supplemental instruction period. |
---|
47 | 47 | | (a-6) The commissioner shall: |
---|
48 | 48 | | (1) provide guidelines to school districts on |
---|
49 | 49 | | research-based best practices and effective strategies that a |
---|
50 | 50 | | district may use in developing an accelerated instruction program; |
---|
51 | 51 | | (2) [and shall] provide resources to districts to |
---|
52 | 52 | | assist in the provision of an accelerated instruction program; and |
---|
53 | 53 | | (3) provide information to districts before the |
---|
54 | 54 | | beginning of each semester on effective uses for each resource |
---|
55 | 55 | | provided under Subdivision (2). |
---|
56 | 56 | | SECTION 2. This Act applies beginning with the 2023-2024 |
---|
57 | 57 | | school year. |
---|
58 | 58 | | SECTION 3. This Act takes effect immediately if it receives |
---|
59 | 59 | | a vote of two-thirds of all the members elected to each house, as |
---|
60 | 60 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
61 | 61 | | Act does not receive the vote necessary for immediate effect, this |
---|
62 | 62 | | Act takes effect September 1, 2023. |
