55 relating to access to criminal history record information for
66 certain employees, volunteers, and contractors, and for applicants
77 for those positions, by the Health and Human Services Commission.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 411.1106, Government Code, is amended by
1010 amending Subsections (b), (c), (d), and (e) and adding Subsections
1111 (b-1), (c-1), and (f) to read as follows:
1212 (b) The [executive commissioner of the] commission[, or the
1313 executive commissioner's designee,] is entitled to obtain [from the
1414 department] criminal history record information as provided by
1515 Subsection (b-1) [maintained by the department] that relates to a
1616 person who is required to be fingerprinted and is:
1717 (1) an applicant for an employment or volunteer
1818 position or an applicant for a contract with the commission [for a
1919 position] in which the person, as an employee, volunteer, or
2020 contractor, an applicable, would have access to sensitive personal
2121 or financial information, as determined by the executive
2222 commissioner, in:
2323 (A) the eligibility services division of the
2424 commission; [or]
2525 (B) the commission's office of inspector
2626 general; or
2727 (C) the regulatory services division of the
2828 commission; or
2929 (2) an employee, volunteer, or contractor of the
3030 commission who has access to sensitive personal or financial
3131 information, as determined by the executive commissioner.
3232 (b-1) Subject to Section 411.087, the commission is
3333 entitled to:
3434 (1) obtain through the Federal Bureau of Investigation
3535 criminal history record information maintained or indexed by that
3636 bureau that pertains to a person described by Subsection (b); and
3737 (2) obtain from the department or any other criminal
3838 justice agency in this state criminal history record information
3939 maintained by the department or other agency that relates to a
4040 person described by Subsection (b).
4141 (c) Criminal history record information obtained by [the
4242 executive commissioner of] the commission[, or by the executive
4343 commissioner's designee,] under Subsection (b-1)(2) [(b)] may not
4444 be released or disclosed, except:
4545 (1) if the information is in a public record at the
4646 time the information is obtained;
4747 (2) on court order;
4848 (3) to a criminal justice agency, upon request;
4949 (4) with the consent of the person who is the subject
5050 of the criminal history record information; or
5151 (5) as provided by Subsection (d).
5252 (c-1) Criminal history record information obtained by the
5353 commission under Subsection (b-1)(1) may not be released or
5454 disclosed to any person.
5555 (d) The commission is not prohibited from disclosing
5656 criminal history record information obtained under Subsection
5757 (b-1)(2) [(b)] in a criminal proceeding or in a hearing conducted by
5858 the commission.
5959 (e) The commission [executive commissioner] shall destroy
6060 all criminal history record information obtained under this section
6161 [Subsection (b)] as soon as practicable after the information is
6262 used for its authorized purpose.
6363 (f) This section does not prohibit the commission from
6464 obtaining and using criminal history record information as provided
6565 by other law.
6666 SECTION 2. This Act takes effect immediately if it receives
6767 a vote of two-thirds of all the members elected to each house, as
6868 provided by Section 39, Article III, Texas Constitution. If this
6969 Act does not receive the vote necessary for immediate effect, this
7070 Act takes effect September 1, 2023.
