| 9 | 9 | | certain school districts from entering into certain contracts. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter B, Chapter 44, Education Code, is |
|---|
| 12 | 12 | | amended by adding Section 44.0314 to read as follows: |
|---|
| 13 | 13 | | Sec. 44.0314. APPLICABILITY OF REQUIREMENTS AND |
|---|
| 14 | 14 | | PROHIBITIONS REGARDING CONFLICTS OF INTEREST. (a) Except as |
|---|
| 15 | 15 | | provided by Subsection (b), Section 2261.252, Government Code, |
|---|
| 16 | 16 | | applies to a school district as if the district were a state agency, |
|---|
| 17 | 17 | | and to a district employee or official as if the employee or |
|---|
| 18 | 18 | | official were a state agency employee or official, to the extent |
|---|
| 19 | 19 | | that that section does not conflict with this code. |
|---|
| 20 | 20 | | (b) This section does not apply to a school district, or to |
|---|
| 21 | 21 | | an employee or official of the district, that is classified by the |
|---|
| 22 | 22 | | agency as: |
|---|
| 23 | 23 | | (1) rural; |
|---|
| 24 | 24 | | (2) non-metropolitan: stable; or |
|---|
| 25 | 25 | | (3) independent town. |
|---|
| 26 | 26 | | SECTION 2. Section 44.0314, Education Code, as added by |
|---|
| 27 | 27 | | this Act, applies only to a contract entered into on or after the |
|---|
| 28 | 28 | | effective date of this Act. |
|---|
| 29 | 29 | | SECTION 3. This Act takes effect September 1, 2023. |
