A BILL TO BE ENTITLED
AN ACT
relating to the disclosure of potential conflicts of interest by
certain school district employees or officials and a prohibition on
certain school districts from entering into certain contracts.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter B, Chapter 44, Education Code, is
amended by adding Section 44.0314 to read as follows:
Sec. 44.0314. APPLICABILITY OF REQUIREMENTS AND
PROHIBITIONS REGARDING CONFLICTS OF INTEREST. (a) Except as
provided by Subsection (b), Section 2261.252, Government Code,
applies to a school district as if the district were a state agency,
and to a district employee or official as if the employee or
official were a state agency employee or official, to the extent
that that section does not conflict with this code.
(b) This section does not apply to a school district, or to
an employee or official of the district, that is classified by the
agency as:
(1) rural;
(2) non-metropolitan: stable; or
(3) independent town.
SECTION 2. Section 44.0314, Education Code, as added by
this Act, applies only to a contract entered into on or after the
effective date of this Act.
SECTION 3. This Act takes effect September 1, 2023.
