55 relating to the use of certain weapons in or on the bed or bank of a
66 navigable river or stream; providing a penalty.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 284.001, Parks and Wildlife Code, is
99 transferred to Subchapter B, Chapter 1, Parks and Wildlife Code,
1010 redesignated as Section 1.014, Parks and Wildlife Code, and amended
1111 to read as follows:
1212 Sec. 1.014 [284.001]. USE OF CERTAIN WEAPONS IN OR ON BED OR
1313 BANK OF NAVIGABLE RIVER OR STREAM [DISCHARGE OF FIREARM]
1414 PROHIBITED. (a) In this section:
1515 (1) "Archery equipment" means a longbow, recurved bow,
1616 compound bow, or crossbow.
1717 (2) "Firearm" has the meaning assigned by Section
1818 62.014.
1919 (3) "Navigable river or stream" has the meaning
2020 assigned by Section 90.001.
2121 (b) [This section applies only to a navigable river or
2222 stream located wholly or partly in Dimmit, Edwards, Frio, Hall,
2323 Kenedy, Llano, Maverick, Real, Uvalde, or Zavala County.
2424 [(c)] Except as provided by Subsection (c) [(d)], a person
2525 may not discharge a firearm or shoot an arrow from any kind of bow
2626 if:
2727 (1) the person is located in or on the bed or bank of a
2828 navigable river or stream at the time the firearm is discharged or
2929 the arrow is shot from the bow; or
3030 (2) any portion of the ammunition discharged or arrow
3131 shot could physically contact the bed or bank of a navigable river
3232 or stream.
3333 (c) [(d)] This section does not apply to:
3434 (1) an individual acting in the scope of the
3535 individual's duties as a peace officer or department employee;
3636 (2) the discharge of a shotgun loaded with ammunition
3737 that releases only shot when discharged; [or]
3838 (3) an individual engaging in fishing using archery
3939 equipment, if the individual is in compliance with Subsection (e);
4040 (4) the discharge of a firearm during the legal taking
4141 of an alligator; or
4242 (5) the discharge of a firearm from the bank of a
4343 navigable river or stream to take a venomous snake or nonindigenous
4444 rodent by:
4545 (A) an owner of the land adjacent to or through
4646 which the navigable river or stream runs; or
4747 (B) an agent of an owner described by Paragraph
4848 (A) [(f)].
4949 (d) [(e)] This section does not limit the ability of a
5050 license holder to carry a handgun under the authority of Subchapter
5151 H, Chapter 411, Government Code.
5252 (e) [(f)] An individual engaging in fishing using archery
5353 equipment may not possess while fishing:
5454 (1) an arrow equipped with fletching of any kind;
5555 (2) an unbarbed arrow; or
5656 (3) a bow that is not equipped with a reel and line.
5757 (f) A person who violates this section commits an offense
5858 that is a Class C Parks and Wildlife Code misdemeanor.
5959 (g) If conduct that constitutes an offense under this
6060 section also constitutes an offense under Title 7, the actor may be
6161 prosecuted under this section or the other law, but not both.
6262 SECTION 2. The heading to Chapter 284, Parks and Wildlife
6363 Code, is repealed.
6464 SECTION 3. This Act takes effect September 1, 2023.
