44 AN ACT
55 relating to prohibiting the physical restraint of or use of
66 chemical irritants or Tasers on certain public school students by
77 peace officers and school security personnel under certain
88 circumstances.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 37.0021(b), Education Code, is amended
1111 by adding Subdivision (5) to read as follows:
1212 (5) "Taser" means a device manufactured, sold, or
1313 distributed by Taser International, Incorporated, that is
1414 intended, designed, made, or adapted to incapacitate a person by
1515 inflicting an electrical charge through the emission of a
1616 projectile or conductive stream. The term, for purposes of this
1717 section, includes a similar device manufactured, sold, or
1818 distributed by another person.
1919 SECTION 2. Section 37.0021, Education Code, is amended by
2020 amending Subsection (d) and adding Subsection (j) to read as
2121 follows:
2222 (d) Subject to Subsection (j), the [The] commissioner by
2323 rule shall adopt procedures for the use of restraint and time-out by
2424 a school district employee or volunteer or an independent
2525 contractor of a district in the case of a student with a disability
2626 receiving special education services under Subchapter A, Chapter
2727 29. A procedure adopted under this subsection must:
2828 (1) be consistent with:
2929 (A) professionally accepted practices and
3030 standards of student discipline and techniques for behavior
3131 management; and
3232 (B) relevant health and safety standards;
3333 (2) identify any discipline management practice or
3434 behavior management technique that requires a district employee or
3535 volunteer or an independent contractor of a district to be trained
3636 before using that practice or technique; and
3737 (3) require a school district to:
3838 (A) provide written notification to the
3939 student's parent or person standing in parental relation to the
4040 student for each use of restraint that includes:
4141 (i) the name of the student;
4242 (ii) the name of the district employee or
4343 volunteer or independent contractor of the district who
4444 administered the restraint;
4545 (iii) the date of the restraint;
4646 (iv) the time that the restraint started
4747 and ended;
4848 (v) the location of the restraint;
4949 (vi) the nature of the restraint;
5050 (vii) a description of the activity in
5151 which the student was engaged immediately preceding the use of the
5252 restraint;
5353 (viii) the behavior of the student that
5454 prompted the restraint;
5555 (ix) any efforts made to de-escalate the
5656 situation and any alternatives to restraint that were attempted;
5757 (x) if the student has a behavior
5858 improvement plan or a behavioral intervention plan, whether the
5959 plan may need to be revised as a result of the behavior that led to
6060 the restraint; and
6161 (xi) if the student does not have a behavior
6262 improvement plan or a behavioral intervention plan, information on
6363 the procedure for the student's parent or person standing in
6464 parental relation to the student to request an admission, review,
6565 and dismissal committee meeting to discuss the possibility of
6666 conducting a functional behavioral assessment of the student and
6767 developing a plan for the student;
6868 (B) include in a student's special education
6969 eligibility school records:
7070 (i) a copy of the written notification
7171 provided to the student's parent or person standing in parental
7272 relation to the student under Paragraph (A);
7373 (ii) information on the method by which the
7474 written notification was sent to the parent or person; and
7575 (iii) the contact information for the
7676 parent or person to whom the district sent the notification; and
7777 (C) if the student has a behavior improvement
7878 plan or behavioral intervention plan, document each use of time-out
7979 prompted by a behavior of the student specified in the student's
8080 plan, including a description of the behavior that prompted the
8181 time-out.
8282 (j) A peace officer performing law enforcement duties or
8383 school security personnel performing security-related duties on
8484 school property or at a school-sponsored or school-related activity
8585 may not restrain or use a chemical irritant spray or Taser on a
8686 student enrolled in fifth grade or below unless the student poses a
8787 serious risk of harm to the student or another person.
8888 SECTION 3. This Act takes effect immediately if it receives
8989 a vote of two-thirds of all the members elected to each house, as
9090 provided by Section 39, Article III, Texas Constitution. If this
9191 Act does not receive the vote necessary for immediate effect, this
9292 Act takes effect September 1, 2023.
