66 AN ACT
77 relating to discrimination on the basis of hair texture or
88 protective hairstyle associated with race.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter Z, Chapter 25, Education Code, is
1111 amended by adding Section 25.902 to read as follows:
1212 Sec. 25.902. PROHIBITION ON CERTAIN DISCRIMINATION IN
1313 STUDENT DRESS OR GROOMING POLICY. (a) In this section, "protective
1414 hairstyle" includes braids, locks, and twists.
1515 (b) Any student dress or grooming policy adopted by a school
1616 district, including a student dress or grooming policy for any
1717 extracurricular activity, may not discriminate against a hair
1818 texture or protective hairstyle commonly or historically
1919 associated with race.
2020 SECTION 2. Subchapter Z, Chapter 51, Education Code, is
2121 amended by adding Section 51.979 to read as follows:
2222 Sec. 51.979. PROHIBITION ON CERTAIN DISCRIMINATION IN
2323 STUDENT DRESS OR GROOMING POLICY. (a) In this section:
2424 (1) "Institution of higher education" has the meaning
2525 assigned by Section 61.003.
2626 (2) "Protective hairstyle" includes braids, locks,
2727 and twists.
2828 (b) Any student dress or grooming policy adopted by an
2929 institution of higher education, including a student dress or
3030 grooming policy for any extracurricular activity, may not
3131 discriminate against a hair texture or protective hairstyle
3232 commonly or historically associated with race.
3333 SECTION 3. Subchapter C, Chapter 21, Labor Code, is amended
3434 by adding Section 21.1095 to read as follows:
3535 Sec. 21.1095. RACIAL DISCRIMINATION BASED ON HAIR TEXTURE
3636 OR PROTECTIVE HAIRSTYLE. (a) In this section, "protective
3737 hairstyle" includes braids, locks, and twists.
3838 (b) A provision in this chapter referring to discrimination
3939 because of race or on the basis of race includes discrimination
4040 because of or on the basis of an employee's hair texture or
4141 protective hairstyle commonly or historically associated with
4242 race.
4343 (c) An employer, labor union, or employment agency commits
4444 an unlawful employment practice if the employer, labor union, or
4545 employment agency adopts or enforces a dress or grooming policy
4646 that discriminates against a hair texture or protective hairstyle
4747 commonly or historically associated with race.
4848 SECTION 4. Subchapter A, Chapter 301, Property Code, is
4949 amended by adding Section 301.0045 to read as follows:
5050 Sec. 301.0045. RACIAL DISCRIMINATION BASED ON HAIR TEXTURE
5151 OR PROTECTIVE HAIRSTYLE. (a) In this section, "protective
5252 hairstyle" includes braids, locks, and twists.
5353 (b) A provision in this chapter, other than a provision in
5454 Subchapter I, referring to discrimination because of race or on the
5555 basis of race includes discrimination because of or on the basis of
5656 a person's hair texture or protective hairstyle commonly or
5757 historically associated with race.
5858 SECTION 5. Section 21.1095, Labor Code, as added by this
5959 Act, applies only to an unlawful employment practice that occurs on
6060 or after the effective date of this Act.
6161 SECTION 6. Section 301.0045, Property Code, as added by
6262 this Act, applies only to a discriminatory housing practice that
6363 occurs on or after the effective date of this Act.
6464 SECTION 7. This Act takes effect September 1, 2023.
