55 relating to a training program for persons investigating suspected
66 child abuse or neglect.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Subchapter D, Chapter 261, Family Code, is
99 amended by adding Section 261.3105 to read as follows:
1010 Sec. 261.3105. TRAINING PROGRAM FOR PERSONS INVESTIGATING
1111 SUSPECTED CHILD ABUSE OR NEGLECT. (a) The department shall develop
1212 a training program for each person who investigates any instance of
1313 suspected child abuse or neglect at the state or local level and the
1414 investigative supervisor of the person.
1515 (b) The training program must include instruction on:
1616 (1) the definitions of abuse and neglect under Section
1717 261.001;
1818 (2) the option for an abbreviated investigation or
1919 administrative closure of certain reported cases under Section
2020 261.3018;
2121 (3) the required notice to an alleged perpetrator of
2222 the right to record an interview under Section 261.3027;
2323 (4) the required provision of information on
2424 investigation procedures and child placement resources under
2525 Section 261.307;
2626 (5) the required notice of the right to request an
2727 administrative review of the department's findings under Section
2828 261.3091;
2929 (6) the investigative standards established under
3030 Section 261.310, including case file documentation;
3131 (7) the required assessment of certain proposed
3232 relative or other designated caregiver placements under Section
3333 264.754;
3434 (8) the department's policies on investigation
3535 dispositions and risk findings appropriate to the type of
3636 investigation;
3737 (9) the department's policy on identifying a potential
3838 relative placement before an adversary hearing;
3939 (10) the department's policy on notifying a kinship
4040 provider of the appeal process for a denied home assessment for
4141 potential placement with the provider placement;
4242 (11) the procedures for defining, identifying, and
4343 supporting protective capabilities of youths 13 years of age or
4444 older;
4545 (12) the burdens of proof applied to the evaluation
4646 and production of evidence;
4747 (13) the rights provided by the Fourth Amendment to
4848 the United States Constitution, the appropriate manner of informing
4949 an alleged perpetrator of those rights, and the search and seizure
5050 elements of those rights; and
5151 (14) information on available community resources for
5252 a child's identified risk factors to avoid delay in referrals for
5353 services and to resources.
5454 (c) The training program must also provide to department
5555 investigators training on forensic investigative techniques and
5656 protocols, including:
5757 (1) techniques for conducting investigative
5858 interviews with alleged perpetrators of and witnesses to alleged
5959 child abuse or neglect;
6060 (2) techniques for searching for and identifying
6161 witnesses and collateral sources who may potentially provide
6262 information regarding an allegation of child abuse or neglect;
6363 (3) protocols for accurately scaling alleged abuse or
6464 neglect markings and injuries;
6565 (4) protocols for photographing alleged abuse or
6666 neglect markings and scenes;
6767 (5) techniques for reconstructing events and
6868 statements using timelines;
6969 (6) protocols for collecting and packaging evidence;
7070 (7) protocols for using notes, photographs, and
7171 timelines to accurately represent an allegation of abuse or
7272 neglect;
7373 (8) methods for analyzing and applying forensic
7474 evidence to the statutory definitions of abuse and neglect under
7575 Section 261.001 and to possible signs and symptoms of abuse and
7676 neglect; and
7777 (9) procedures for analyzing and applying forensic
7878 evidence to statutory standards established in this chapter,
7979 including the burden of proof.
8080 (d) The department shall administer to each investigator
8181 and investigative supervisor an examination to test the
8282 individual's knowledge and competency of the information provided
8383 in the training program. An investigator or investigative
8484 supervisor may not be assigned to investigate or supervise the
8585 investigation of any case until the investigator or supervisor
8686 successfully completes the training program and passes the
8787 examination.
8888 (e) In developing and implementing the training program,
8989 the department shall:
9090 (1) encourage professionalism, procedural
9191 standardization, and investigative disposition accuracy in the
9292 investigations of suspected child abuse or neglect; and
9393 (2) collaborate with:
9494 (A) appropriate Department of Public Safety
9595 personnel;
9696 (B) licensed attorneys;
9797 (C) forensic medical professionals;
9898 (D) appropriate law enforcement agency
9999 personnel; and
100100 (E) any other appropriate professionals.
101101 SECTION 2. (a) As soon as practicable after the effective
102102 date of this Act, the commissioner of the Department of Family and
103103 Protective Services shall adopt the rules necessary to implement
104104 the changes in law made by this Act.
105105 (b) Section 261.3105(d), Family Code, as added by this Act,
106106 applies only to investigation of a case assigned to an investigator
107107 or investigative supervisor on or after January 1, 2025.
108108 SECTION 3. This Act takes effect September 1, 2023.
