77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 38.075(e), Utilities Code, is amended to
99 read as follows:
1010 (e) Notwithstanding any other provision of this subtitle,
1111 the commission shall allow a transmission and distribution utility
1212 to design and operate a load management program for
1313 [nonresidential] customers to be used where the independent
1414 organization certified under Section 39.151 for the ERCOT power
1515 region has declared a Level 2 Emergency or a higher level of
1616 emergency or has otherwise directed the transmission and
1717 distribution utility to shed load. A transmission and distribution
1818 utility implementing a load management program under this
1919 subsection shall be permitted to recover the reasonable and
2020 necessary costs of the load management program under Chapter 36. A
2121 load management program operated under this subsection is not
2222 considered a competitive service.
2323 SECTION 2. This Act takes effect immediately if it receives
2424 a vote of two-thirds of all the members elected to each house, as
2525 provided by Section 39, Article III, Texas Constitution. If this
2626 Act does not receive the vote necessary for immediate effect, this
2727 Act takes effect September 1, 2023.
