| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter G, Chapter 48, Education Code, is |
|---|
| 11 | 11 | | amended by adding Section 48.307 to read as follows: |
|---|
| 12 | 12 | | Sec. 48.307. DAY PLACEMENT PROGRAM FUNDING. (a) For each |
|---|
| 13 | 13 | | qualifying day placement program that a regional education service |
|---|
| 14 | 14 | | center makes available in partnership with a school district, |
|---|
| 15 | 15 | | open-enrollment charter school, or shared services arrangement, |
|---|
| 16 | 16 | | the center is entitled to an allotment of: |
|---|
| 17 | 17 | | (1) $250,000 for the first year of the program's |
|---|
| 18 | 18 | | operation; and |
|---|
| 19 | 19 | | (2) $150,000 for each year of the program's operation |
|---|
| 20 | 20 | | after the first year. |
|---|
| 21 | 21 | | (b) A day placement program qualifies for purposes of |
|---|
| 22 | 22 | | Subsection (a) if: |
|---|
| 23 | 23 | | (1) the program complies with commissioner rules |
|---|
| 24 | 24 | | regarding contracts for the placement of students receiving special |
|---|
| 25 | 25 | | education services in a day placement program; |
|---|
| 26 | 26 | | (2) the program offers services to students who are |
|---|
| 27 | 27 | | enrolled at any school district or open-enrollment charter school |
|---|
| 28 | 28 | | in the county in which the program is offered, unless the |
|---|
| 29 | 29 | | commissioner by rule waives or modifies the requirement under this |
|---|
| 30 | 30 | | subdivision for the program to serve all students in a county; and |
|---|
| 31 | 31 | | (3) the agency has designated the program for service |
|---|
| 32 | 32 | | in the county in which the program is offered. |
|---|
| 33 | 33 | | SECTION 2. This Act takes effect September 1, 2023. |
