66 AN ACT
77 relating to an allotment for day placement programs under the
88 Foundation School Program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter G, Chapter 48, Education Code, is
1111 amended by adding Section 48.307 to read as follows:
1212 Sec. 48.307. DAY PLACEMENT PROGRAM FUNDING. (a) For each
1313 qualifying day placement program that a regional education service
1414 center makes available in partnership with a school district,
1515 open-enrollment charter school, or shared services arrangement,
1616 the center is entitled to an allotment of:
1717 (1) $250,000 for the first year of the program's
1818 operation; and
1919 (2) $150,000 for each year of the program's operation
2020 after the first year.
2121 (b) A day placement program qualifies for purposes of
2222 Subsection (a) if:
2323 (1) the program complies with commissioner rules
2424 regarding contracts for the placement of students receiving special
2525 education services in a day placement program;
2626 (2) the program offers services to students who are
2727 enrolled at any school district or open-enrollment charter school
2828 in the county in which the program is offered, unless the
2929 commissioner by rule waives or modifies the requirement under this
3030 subdivision for the program to serve all students in a county; and
3131 (3) the agency has designated the program for service
3232 in the county in which the program is offered.
3333 SECTION 2. This Act takes effect September 1, 2023.
