88R12353 KJE-F By: Perry S.B. No. 1713 A BILL TO BE ENTITLED AN ACT relating to an allotment for day placement programs under the Foundation School Program. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Subchapter G, Chapter 48, Education Code, is amended by adding Section 48.307 to read as follows: Sec. 48.307. DAY PLACEMENT PROGRAM FUNDING. (a) For each qualifying day placement program that a regional education service center makes available in partnership with a school district, open-enrollment charter school, or shared services arrangement, the center is entitled to an allotment of: (1) $250,000 for the first year of the program's operation; and (2) $150,000 for each year of the program's operation after the first year. (b) A day placement program qualifies for purposes of Subsection (a) if: (1) the program complies with commissioner rules regarding contracts for the placement of students receiving special education services in a day placement program; (2) the program offers services to students who are enrolled at any school district or open-enrollment charter school in the county in which the program is offered, unless the commissioner by rule waives or modifies the requirement under this subdivision for the program to serve all students in a county; and (3) the agency has designated the program for service in the county in which the program is offered. SECTION 2. This Act takes effect September 1, 2023.
