| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 8802.1045(g), Special District Local |
|---|
| 11 | 11 | | Laws Code, is amended to read as follows: |
|---|
| 12 | 12 | | (g) This subsection applies only to a well located in the |
|---|
| 13 | 13 | | shared territory described by Section 8802.0035. Notwithstanding |
|---|
| 14 | 14 | | Subsection (b), before September 1, 2023, the district may not |
|---|
| 15 | 15 | | charge an annual production fee of more than 17 cents per thousand |
|---|
| 16 | 16 | | gallons of water authorized to be produced under a permit from a |
|---|
| 17 | 17 | | well under this subsection, if the water is permitted for any use |
|---|
| 18 | 18 | | other than agricultural use. The district may increase the annual |
|---|
| 19 | 19 | | production fee under this subsection by not more than 10 cents per |
|---|
| 20 | 20 | | thousand gallons per year beginning on September 1, 2023, for water |
|---|
| 21 | 21 | | permitted for nonagricultural purposes, until the annual |
|---|
| 22 | 22 | | production fee is equal to the maximum amount set forth in |
|---|
| 23 | 23 | | Subsection (b). |
|---|
| 24 | 24 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 25 | 25 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 26 | 26 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 27 | 27 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 28 | 28 | | Act takes effect September 1, 2023. |
