99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 8802.1045(g), Special District Local
1111 Laws Code, is amended to read as follows:
1212 (g) This subsection applies only to a well located in the
1313 shared territory described by Section 8802.0035. Notwithstanding
1414 Subsection (b), before September 1, 2023, the district may not
1515 charge an annual production fee of more than 17 cents per thousand
1616 gallons of water authorized to be produced under a permit from a
1717 well under this subsection, if the water is permitted for any use
1818 other than agricultural use. The district may increase the annual
1919 production fee under this subsection by not more than 10 cents per
2020 thousand gallons per year beginning on September 1, 2023, for water
2121 permitted for nonagricultural purposes, until the annual
2222 production fee is equal to the maximum amount set forth in
2323 Subsection (b).
2424 SECTION 2. This Act takes effect immediately if it receives
2525 a vote of two-thirds of all the members elected to each house, as
2626 provided by Section 39, Article III, Texas Constitution. If this
2727 Act does not receive the vote necessary for immediate effect, this
2828 Act takes effect September 1, 2023.
