| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subchapter A, Chapter 264, Family Code, is |
|---|
| 13 | 13 | | amended by adding Section 264.020 to read as follows: |
|---|
| 14 | 14 | | Sec. 264.020. PLACEMENT OF CHILDREN IN CONSERVATORSHIP OF |
|---|
| 15 | 15 | | DEPARTMENT OF FAMILY AND PROTECTIVE SERVICES. (a) In this section, |
|---|
| 16 | 16 | | "child" means a person who: |
|---|
| 17 | 17 | | (1) is younger than 22 years of age and for whom the |
|---|
| 18 | 18 | | department has been appointed managing conservator of the child |
|---|
| 19 | 19 | | before the child's 18th birthday; or |
|---|
| 20 | 20 | | (2) is the responsibility of an agency with which the |
|---|
| 21 | 21 | | department has entered into an agreement to provide care and |
|---|
| 22 | 22 | | supervision of the child. |
|---|
| 23 | 23 | | (b) In making the initial or a subsequent placement decision |
|---|
| 24 | 24 | | for a child, the department shall give preference to persons in the |
|---|
| 25 | 25 | | following order: |
|---|
| 26 | 26 | | (1) a person related to the child by blood, marriage, |
|---|
| 27 | 27 | | or adoption; |
|---|
| 28 | 28 | | (2) a person with whom the child has a long-standing |
|---|
| 29 | 29 | | and significant relationship; |
|---|
| 30 | 30 | | (3) a foster home; and |
|---|
| 31 | 31 | | (4) a general residential operation. |
|---|
| 32 | 32 | | SECTION 2. Section 264.020, Family Code, as added by this |
|---|
| 33 | 33 | | Act, applies only to an initial or subsequent placement decision |
|---|
| 34 | 34 | | made by the Department of Family and Protective Services on or after |
|---|
| 35 | 35 | | the effective date of this Act. |
|---|
| 36 | 36 | | SECTION 3. This Act takes effect September 1, 2023. |
