88 AN ACT
99 relating to certain placements for children in the conservatorship
1010 of the Department of Family and Protective Services.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter A, Chapter 264, Family Code, is
1313 amended by adding Section 264.020 to read as follows:
1414 Sec. 264.020. PLACEMENT OF CHILDREN IN CONSERVATORSHIP OF
1515 DEPARTMENT OF FAMILY AND PROTECTIVE SERVICES. (a) In this section,
1616 "child" means a person who:
1717 (1) is younger than 22 years of age and for whom the
1818 department has been appointed managing conservator of the child
1919 before the child's 18th birthday; or
2020 (2) is the responsibility of an agency with which the
2121 department has entered into an agreement to provide care and
2222 supervision of the child.
2323 (b) In making the initial or a subsequent placement decision
2424 for a child, the department shall give preference to persons in the
2525 following order:
2626 (1) a person related to the child by blood, marriage,
2727 or adoption;
2828 (2) a person with whom the child has a long-standing
2929 and significant relationship;
3030 (3) a foster home; and
3131 (4) a general residential operation.
3232 SECTION 2. Section 264.020, Family Code, as added by this
3333 Act, applies only to an initial or subsequent placement decision
3434 made by the Department of Family and Protective Services on or after
3535 the effective date of this Act.
3636 SECTION 3. This Act takes effect September 1, 2023.
