| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 552.103, Government Code, is amended by |
|---|
| 13 | 13 | | adding Subsection (d) to read as follows: |
|---|
| 14 | 14 | | (d) The exception to disclosure provided by this section |
|---|
| 15 | 15 | | does not apply to information requested under this chapter if: |
|---|
| 16 | 16 | | (1) the information relates to a general, primary, or |
|---|
| 17 | 17 | | special election, as those terms are defined by Section 1.005, |
|---|
| 18 | 18 | | Election Code; |
|---|
| 19 | 19 | | (2) the information is in the possession of a |
|---|
| 20 | 20 | | governmental body that administers elections described by |
|---|
| 21 | 21 | | Subdivision (1); and |
|---|
| 22 | 22 | | (3) the governmental body described by Subdivision (2) |
|---|
| 23 | 23 | | is not a governmental body described by Section 552.003(1)(A)(i). |
|---|
| 24 | 24 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 25 | 25 | | to a request for information that is received by a governmental body |
|---|
| 26 | 26 | | on or after the effective date of this Act. |
|---|
| 27 | 27 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 28 | 28 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 29 | 29 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 30 | 30 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 31 | 31 | | Act takes effect September 1, 2023. |
