88 AN ACT
99 relating to disclosure under the public information law of
1010 information related to elections.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 552.103, Government Code, is amended by
1313 adding Subsection (d) to read as follows:
1414 (d) The exception to disclosure provided by this section
1515 does not apply to information requested under this chapter if:
1616 (1) the information relates to a general, primary, or
1717 special election, as those terms are defined by Section 1.005,
1818 Election Code;
1919 (2) the information is in the possession of a
2020 governmental body that administers elections described by
2121 Subdivision (1); and
2222 (3) the governmental body described by Subdivision (2)
2323 is not a governmental body described by Section 552.003(1)(A)(i).
2424 SECTION 2. The change in law made by this Act applies only
2525 to a request for information that is received by a governmental body
2626 on or after the effective date of this Act.
2727 SECTION 3. This Act takes effect immediately if it receives
2828 a vote of two-thirds of all the members elected to each house, as
2929 provided by Section 39, Article III, Texas Constitution. If this
3030 Act does not receive the vote necessary for immediate effect, this
3131 Act takes effect September 1, 2023.
