77 relating to the capture or use of a biometric identifier.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 503.001, Business & Commerce Code, is
1010 amended by adding Subsection (f) to read as follows:
1111 (f) (1) A state or local government, including a school, its
1212 contractor, subcontractor, or agents that captures a biometric
1313 identifier for the purpose of preventing safety or security
1414 concerns, theft, or other illegal activity may not sell the
1515 biometric identifier to a third-party.
1616 (2) This section shall not be construed to prohibit a
1717 State or local government agency, including a school, or its
1818 contractors, subcontractors, or agents from capturing biometric
1919 identifiers for the purpose of preventing, detecting, or responding
2020 to safety or security incidents, theft, or other illegal activity.
2121 SECTION 2. This Act takes effect September 1, 2023.
