 A BILL TO BE ENTITLED
 AN ACT
 relating to the capture or use of a biometric identifier.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Section 503.001, Business & Commerce Code, is
 amended by adding Subsection (f) to read as follows:
 (f)  (1) A state or local government, including a school, its
 contractor, subcontractor, or agents that captures a biometric
 identifier for the purpose of preventing safety or security
 concerns, theft, or other illegal activity may not sell the
 biometric identifier to a third-party.
 (2)  This section shall not be construed to prohibit a
 State or local government agency, including a school, or its
 contractors, subcontractors, or agents from capturing biometric
 identifiers for the purpose of preventing, detecting, or responding
 to safety or security incidents, theft, or other illegal activity.
 SECTION 2.  This Act takes effect September 1, 2023.
