55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the regulation of platting and subdivisions of land by a
88 municipality or county.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 212.003(a), Local Government Code, is
1111 amended to read as follows:
1212 (a) The governing body of a municipality by ordinance may
1313 extend to the extraterritorial jurisdiction of the municipality the
1414 application of municipal ordinances adopted under Section 212.002
1515 and other municipal ordinances relating to access to public roads
1616 or the pumping, extraction, and use of groundwater by persons other
1717 than retail public utilities, as defined by Section 13.002, Water
1818 Code, for the purpose of preventing the use or contact with
1919 groundwater that presents an actual or potential threat to human
2020 health. However, unless otherwise authorized by state law, in its
2121 extraterritorial jurisdiction a municipality shall not regulate,
2222 either directly or indirectly:
2323 (1) the use of any building or property for business,
2424 industrial, residential, or other purposes;
2525 (2) the bulk, height, or number of buildings
2626 constructed on a particular tract of land;
2727 (3) the size of a building that can be constructed on a
2828 particular tract of land, including without limitation any
2929 restriction on the ratio of building floor space to the land square
3030 footage;
3131 (4) the minimum size of a lot, dimensions of a lot,
3232 minimum width of a lot frontage, minimum distance a lot must be set
3333 back from a road or property line, or another component of lot
3434 density on a particular tract of land;
3535 (5) the number of residential units that can be built
3636 per acre of land; or
3737 (6) [(5)] the size, type, or method of construction of
3838 a water or wastewater facility that can be constructed to serve a
3939 developed tract of land if[:
4040 [(A)] the facility meets the minimum standards
4141 established for water or wastewater facilities by state and federal
4242 regulatory entities[; and
4343 [(B) the developed tract of land is:
4444 [(i) located in a county with a population
4545 of 2.8 million or more; and
4646 [(ii) served by:
4747 [(a) on-site septic systems
4848 constructed before September 1, 2001, that fail to provide adequate
4949 services; or
5050 [(b) on-site water wells constructed
5151 before September 1, 2001, that fail to provide an adequate supply of
5252 safe drinking water].
5353 SECTION 2. Sections 232.101(a) and (b), Local Government
5454 Code, are amended to read as follows:
5555 (a) By an order adopted and entered in the minutes of the
5656 commissioners court and after a notice is published in a newspaper
5757 of general circulation in the county, the commissioners court may
5858 adopt rules governing plats and subdivisions of land within the
5959 unincorporated area of the county as authorized by this subchapter
6060 [to promote the health, safety, morals, or general welfare of the
6161 county and the safe, orderly, and healthful development of the
6262 unincorporated area of the county].
6363 (b) A [Unless otherwise authorized by state law, a]
6464 commissioners court shall not regulate, either directly or
6565 indirectly [under this section]:
6666 (1) the use of any building or property for business,
6767 industrial, residential, or other purposes;
6868 (2) the bulk, height, or number of buildings
6969 constructed on a particular tract of land;
7070 (3) the size of a building that can be constructed on a
7171 particular tract of land, including without limitation and
7272 restriction on the ratio of building floor space to the land square
7373 footage;
7474 (4) the minimum size of a lot, dimensions of a lot,
7575 minimum width of a lot frontage, minimum distance a lot must be set
7676 back from a road or property line, or another component of lot
7777 density on a particular tract of land;
7878 (5) the number of residential units that can be built
7979 per acre of land;
8080 (6) [(5)] a plat or subdivision in an adjoining
8181 county; or
8282 (7) [(6)] road access to a plat or subdivision in an
8383 adjoining county.
8484 SECTION 3. Sections 232.103 and 232.104, Local Government
8585 Code, are repealed.
8686 SECTION 4. The changes in law made by this Act apply only to
8787 a plat application filed on or after the effective date of this Act.
8888 A plat application filed before the effective date of this Act is
8989 governed by the law in effect on the date the application was filed,
9090 and the former law is continued in effect for that purpose.
9191 SECTION 5. This Act takes effect immediately if it receives
9292 a vote of two-thirds of all the members elected to each house, as
9393 provided by Section 39, Article III, Texas Constitution. If this
9494 Act does not receive the vote necessary for immediate effect, this
9595 Act takes effect September 1, 2023.
