55 relating to permit fees for groundwater wells imposed by the
66 Southeast Texas Groundwater Conservation District.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 8868.153, Special District Local Laws
99 Code, is amended to read as follows:
1010 Sec. 8868.153. PERMIT FEES. (a) The district by rule may
1111 impose a reasonable fee on each well that is not exempt from
1212 regulation by the district and for which a permit is issued by the
1313 district.
1414 (b) The fee must be based on the amount of water to be
1515 withdrawn from the well.
1616 (c) The fee may not exceed seven cents [one cent] per
1717 thousand gallons of groundwater withdrawn for any purpose.
1818 SECTION 2. This Act takes effect immediately if it receives
1919 a vote of two-thirds of all the members elected to each house, as
2020 provided by Section 39, Article III, Texas Constitution. If this
2121 Act does not receive the vote necessary for immediate effect, this
2222 Act takes effect September 1, 2023.
