| 6 | 6 | | trafficking penalties by certain schools. |

| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 8 | 8 | | SECTION 1. Sections 37.086(a), (b), and (c), Education |
|---|
| 9 | 9 | | Code, are amended to read as follows: |
|---|
| 10 | 10 | | (a) In this section, "school"[: |
|---|
| 11 | 11 | | [(1) "Premises" has the meaning assigned by Section |
|---|
| 12 | 12 | | 481.134, Health and Safety Code. |
|---|
| 13 | 13 | | [(2) "School"] means a public [or private] primary or |
|---|
| 14 | 14 | | secondary school. |
|---|
| 15 | 15 | | (b) Each public school shall post warning signs of the |
|---|
| 16 | 16 | | increased penalties for trafficking of persons under Section |
|---|
| 17 | 17 | | 20A.02(b-1)(2), Penal Code, in a [at the following locations: |
|---|
| 18 | 18 | | [(1) parallel to and along the exterior boundaries of |
|---|
| 19 | 19 | | the school's premises; |
|---|
| 20 | 20 | | [(2) at each roadway or other way of access to the |
|---|
| 21 | 21 | | premises; |
|---|
| 22 | 22 | | [(3) for premises not fenced, at least every five |
|---|
| 23 | 23 | | hundred feet along the exterior boundaries of the premises; |
|---|
| 24 | 24 | | [(4) at each entrance to the premises; and |
|---|
| 25 | 25 | | [(5) at] conspicuous place [places] reasonably likely |
|---|
| 26 | 26 | | to be viewed by all school employees and visitors [persons entering |
|---|
| 27 | 27 | | the premises]. |
|---|
| 28 | 28 | | (c) The agency, in consultation with the human trafficking |
|---|
| 29 | 29 | | prevention task force created under Section 402.035, Government |
|---|
| 30 | 30 | | Code, shall adopt rules regarding the [placement, installation, |
|---|
| 31 | 31 | | design, size,] wording[, and maintenance procedures] for the |
|---|
| 32 | 32 | | warning signs required under this section and requiring[. The |
|---|
| 33 | 33 | | rules must require] that each warning sign: |
|---|
| 34 | 34 | | (1) include a description of the provisions of Section |
|---|
| 35 | 35 | | 20A.02(b-1), Penal Code, including the penalties for violating that |
|---|
| 36 | 36 | | section; |
|---|
| 37 | 37 | | (2) be written in English and Spanish; and |
|---|
| 38 | 38 | | (3) be at least 8-1/2 by 11 inches in size. |
|---|
| 39 | 39 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 40 | 40 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 41 | 41 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 42 | 42 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 43 | 43 | | Act takes effect September 1, 2023. |
