55 relating to the required posting of signs regarding human
66 trafficking penalties by certain schools.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Sections 37.086(a), (b), and (c), Education
99 Code, are amended to read as follows:
1010 (a) In this section, "school"[:
1111 [(1) "Premises" has the meaning assigned by Section
1212 481.134, Health and Safety Code.
1313 [(2) "School"] means a public [or private] primary or
1414 secondary school.
1515 (b) Each public school shall post warning signs of the
1616 increased penalties for trafficking of persons under Section
1717 20A.02(b-1)(2), Penal Code, in a [at the following locations:
1818 [(1) parallel to and along the exterior boundaries of
1919 the school's premises;
2020 [(2) at each roadway or other way of access to the
2121 premises;
2222 [(3) for premises not fenced, at least every five
2323 hundred feet along the exterior boundaries of the premises;
2424 [(4) at each entrance to the premises; and
2525 [(5) at] conspicuous place [places] reasonably likely
2626 to be viewed by all school employees and visitors [persons entering
2727 the premises].
2828 (c) The agency, in consultation with the human trafficking
2929 prevention task force created under Section 402.035, Government
3030 Code, shall adopt rules regarding the [placement, installation,
3131 design, size,] wording[, and maintenance procedures] for the
3232 warning signs required under this section and requiring[. The
3333 rules must require] that each warning sign:
3434 (1) include a description of the provisions of Section
3535 20A.02(b-1), Penal Code, including the penalties for violating that
3636 section;
3737 (2) be written in English and Spanish; and
3838 (3) be at least 8-1/2 by 11 inches in size.
3939 SECTION 2. This Act takes effect immediately if it receives
4040 a vote of two-thirds of all the members elected to each house, as
4141 provided by Section 39, Article III, Texas Constitution. If this
4242 Act does not receive the vote necessary for immediate effect, this
4343 Act takes effect September 1, 2023.
