66 relating to automatic recounts of certain elections.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 216.001, Election Code, is amended to
99 read as follows:
1010 Sec. 216.001. APPLICABILITY OF CHAPTER. This chapter
1111 applies only to an election that results in:
1212 (1) a tie vote as provided by Sections 2.002(i),
1313 2.023(b) and (c), and 2.028;
1414 (2) a candidate defeated or eliminated by one-half of
1515 one percent or less of the votes cast for that office; or
1616 (3) a measure submitted to voters that is approved or
1717 defeated by one-half of one percent or less of the votes cast on
1818 that measure.
1919 SECTION 2. Section 216.004, Election Code, is amended to
2020 read as follows:
2121 Sec. 216.004. COUNTING PROCEDURES. (a) The method of
2222 counting votes in an automatic recount consists of using a
2323 generally accepted sampling technique to sample the following for
2424 discrepancies:
2525 (1) 100 percent of electronic ballots;
2626 (2) five percent of early voting ballots voted by
2727 mail;
2828 (3) five percent of the polling place locations
2929 established for early voting; and
3030 (4) five percent of the polling place locations
3131 established for election day [is the same method of counting used in
3232 the election that resulted in the tie vote].
3333 (b) If the authority designated under Section 212.026
3434 determines there are discrepancies of 0.5 percent or greater for
3535 any of the four categories based on the statistical sample under
3636 Subsection (a), the authority shall order a recount under Section
3737 216.003.
3838 (c) The secretary of state shall adopt rules and procedures
3939 for the implementation of this section.
4040 SECTION 3. This Act takes effect September 1, 2023.
