99 A BILL TO BE ENTITLED
1010 AN ACT
1111 relating to an exemption from jury service for the spouse of an
1212 officer or employee in the legislative branch of government.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 62.106(a), Government Code, is amended
1515 to read as follows:
1616 (a) A person qualified to serve as a petit juror may
1717 establish an exemption from jury service if the person:
1818 (1) is over 70 years of age;
1919 (2) has legal custody of a child younger than 12 years
2020 of age and the person's service on the jury requires leaving the
2121 child without adequate supervision;
2222 (3) is a student of a public or private secondary
2323 school;
2424 (4) is a person enrolled and in actual attendance at an
2525 institution of higher education;
2626 (5) is an officer or an employee, or the spouse of an
2727 officer or employee, of the senate, the house of representatives,
2828 or any department, commission, board, office, or other agency in
2929 the legislative branch of state government;
3030 (6) is summoned for service in a county with a
3131 population of at least 200,000, unless that county uses a jury plan
3232 under Section 62.011 and the period authorized under Section
3333 62.011(b)(5) exceeds two years, and the person has served as a petit
3434 juror in the county during the 24-month period preceding the date
3535 the person is to appear for jury service;
3636 (7) is the primary caretaker of a person who is unable
3737 to care for himself or herself;
3838 (8) except as provided by Subsection (b), is summoned
3939 for service in a county with a population of at least 250,000 and
4040 the person has served as a petit juror in the county during the
4141 three-year period preceding the date the person is to appear for
4242 jury service; or
4343 (9) is a member of the United States military forces
4444 serving on active duty and deployed to a location away from the
4545 person's home station and out of the person's county of residence.
4646 SECTION 2. This Act takes effect September 1, 2023.
