| 5 | 5 | | relating to public acknowledgment of donations made to the Texas |

| 6 | 6 | | Department of Transportation. |

| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 201.206, Transportation Code, is amended |
|---|
| 9 | 9 | | to read as follows: |
|---|
| 10 | 10 | | Sec. 201.206. DONATIONS AND CONTRIBUTIONS. (a) For the |
|---|
| 11 | 11 | | purpose of carrying out its functions and duties, the department |
|---|
| 12 | 12 | | may accept, from any source, a donation or contribution in any form, |
|---|
| 13 | 13 | | including realty, personalty, money, materials, or services. |
|---|
| 14 | 14 | | (b) The department may enter into an agreement with a donor |
|---|
| 15 | 15 | | to publicly acknowledge donations made to the department. The |
|---|
| 16 | 16 | | public acknowledgment may not contain comparative or qualitative |
|---|
| 17 | 17 | | descriptions of the donor's products, services, facilities, or |
|---|
| 18 | 18 | | companies. |
|---|
| 19 | 19 | | (c) If a person makes a donation to the department's |
|---|
| 20 | 20 | | roadside assistance and safety service patrol program, the |
|---|
| 21 | 21 | | department may post an acknowledgment of the donation on a vehicle |
|---|
| 22 | 22 | | or equipment the department uses for the program. |
|---|
| 23 | 23 | | (d) The commission may adopt rules for the acknowledgment of |
|---|
| 24 | 24 | | donations under this section. |
|---|
| 25 | 25 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 26 | 26 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 27 | 27 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 28 | 28 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 29 | 29 | | Act takes effect September 1, 2023. |
