| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 241.023, Health and Safety Code, is |
|---|
| 11 | 11 | | amended by adding Subsection (c-4) to read as follows: |

| 12 | 12 | | (c-4) The executive commissioner shall adopt rules and |
|---|
| 13 | 13 | | standards to allow an establishment that specializes in providing |
|---|
| 14 | 14 | | services to infants diagnosed with neonatal abstinence syndrome to |
|---|
| 15 | 15 | | be licensed as a special hospital under this section. |
|---|
| 16 | 16 | | SECTION 2. Not later than December 1, 2023, the executive |
|---|
| 17 | 17 | | commissioner of the Health and Human Services Commission shall |
|---|
| 18 | 18 | | adopt the rules and standards necessary to implement Section |
|---|
| 19 | 19 | | 241.023(c-4), Health and Safety Code, as added by this Act. |
|---|
| 20 | 20 | | SECTION 3. This Act takes effect September 1, 2023. |
