6 | 6 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

7 | 7 | | SECTION 1. Section 41.013, Government Code, is amended to |
---|
8 | 8 | | read as follows: |
---|
9 | 9 | | Sec. 41.013. COMPENSATION OF CERTAIN PROSECUTORS. Except |
---|
10 | 10 | | as otherwise provided by law, a district attorney or criminal |
---|
11 | 11 | | district attorney is entitled to receive from the state: |
---|
12 | 12 | | (1) annual compensation in an amount equal to at least |
---|
13 | 13 | | 80 percent of the state annual salary as set by the General |
---|
14 | 14 | | Appropriations Act in accordance with Section 659.012 paid to a |
---|
15 | 15 | | district judge with comparable years of service as the district |
---|
16 | 16 | | attorney or criminal district attorney; and |
---|
17 | 17 | | (2) a monthly amount of longevity pay based on the |
---|
18 | 18 | | district attorney's or criminal district attorney's years of |
---|
19 | 19 | | service that would be paid to the district attorney or criminal |
---|
20 | 20 | | district attorney under Section 659.0445 if the district attorney |
---|
21 | 21 | | or criminal district attorney were a judge or justice described by |
---|
22 | 22 | | Section 659.0445(a). |
---|
23 | 23 | | SECTION 2. Section 46.003(a), Government Code, is amended |
---|
24 | 24 | | to read as follows: |
---|
25 | 25 | | (a) The state prosecuting attorney and each state |
---|
26 | 26 | | prosecutor is entitled to receive from the state: |
---|
27 | 27 | | (1) a salary in an amount equal to the state annual |
---|
28 | 28 | | salary as set by the General Appropriations Act in accordance with |
---|
29 | 29 | | Section 659.012 paid to a district judge with comparable years of |
---|
30 | 30 | | service as the state prosecuting attorney or state prosecutor; and |
---|
31 | 31 | | (2) a monthly amount of longevity pay based on the |
---|
32 | 32 | | state prosecuting attorney's or state prosecutor's years of service |
---|
33 | 33 | | that would be paid to the state prosecuting attorney or state |
---|
34 | 34 | | prosecutor under Section 659.0445 if the state prosecuting attorney |
---|
35 | 35 | | or state prosecutor were a judge or justice described by Section |
---|
36 | 36 | | 659.0445(a). |
---|
37 | 37 | | SECTION 3. Sections 41.013 and 46.003(a), Government Code, |
---|
38 | 38 | | as amended by this Act, apply beginning with the first pay period |
---|
39 | 39 | | that begins on or after the effective date of this Act. |
---|
40 | 40 | | SECTION 4. This Act takes effect September 1, 2023. |
