| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 312.016, Government Code, is amended by |
|---|
| 10 | 10 | | adding Subsection (d) to read as follows: |

| 11 | 11 | | (d) This state shall observe daylight saving time |
|---|
| 12 | 12 | | year-round. This subsection applies to both the portion of this |
|---|
| 13 | 13 | | state using central standard time as the official standard time and |
|---|
| 14 | 14 | | the portion of this state using mountain standard time as the |
|---|
| 15 | 15 | | official standard time. |

| 16 | 16 | | SECTION 2. If a court finds that the State of Texas is not |
|---|
| 17 | 17 | | authorized by federal law to implement Section 312.016(d), |
|---|
| 18 | 18 | | Government Code, as added by this Act, Section 312.016(d), |
|---|
| 19 | 19 | | Government Code, as added by this Act, has full force and effect on |
|---|
| 20 | 20 | | the date the United States Congress enacts legislation that becomes |
|---|
| 21 | 21 | | law that authorizes the State of Texas to observe daylight saving |
|---|
| 22 | 22 | | time year-round. |

| 23 | 23 | | SECTION 3. This Act takes effect September 1, 2023. |
