| 6 | 6 | | portion of the Edwards Aquifer. |

| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 27.051(i), Water Code, is amended to |
|---|
| 9 | 9 | | read as follows: |
|---|
| 10 | 10 | | (i) For purposes of this subsection, "Edwards Aquifer" has |
|---|
| 11 | 11 | | the meaning assigned by Section 26.046(a). Except as otherwise |
|---|
| 12 | 12 | | provided by this subsection, the commission may not authorize by |
|---|
| 13 | 13 | | rule or permit an injection well that transects or terminates in the |
|---|
| 14 | 14 | | Edwards Aquifer. The commission by rule or permit may authorize: |
|---|
| 15 | 15 | | (1) injection of groundwater withdrawn from the |
|---|
| 16 | 16 | | Edwards Aquifer; |
|---|
| 17 | 17 | | (2) injections of storm water, flood water, or |
|---|
| 18 | 18 | | groundwater through improved sinkholes or caves located in karst |
|---|
| 19 | 19 | | topographic areas; [or] |
|---|
| 20 | 20 | | (3) injections of water made in accordance with |
|---|
| 21 | 21 | | Section 1.44(e)(3), Chapter 626, Acts of the 73rd Legislature, |
|---|
| 22 | 22 | | Regular Session, 1993; or |
|---|
| 23 | 23 | | (4) an aquifer storage and recovery project that |
|---|
| 24 | 24 | | includes an ASR injection well, as defined under Section 27.151, |
|---|
| 25 | 25 | | that transects the Edwards Aquifer in the area of Williamson County |
|---|
| 26 | 26 | | east of Interstate Highway 35 for the injection of water into a |
|---|
| 27 | 27 | | geologic formation that underlies the Edwards Aquifer. |
|---|
| 28 | 28 | | SECTION 2. Not later than March 1, 2024, the Texas |
|---|
| 29 | 29 | | Commission on Environmental Quality shall adopt rules to implement |
|---|
| 30 | 30 | | Section 27.051(i), Water Code, as amended by this Act. |
|---|
| 31 | 31 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 32 | 32 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 33 | 33 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 34 | 34 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 35 | 35 | | Act takes effect September 1, 2023. |
