55 relating to the authority of hospitals in certain counties to drill

88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter A, Chapter 311, Health and Safety
1010 Code, is amended by adding Section 311.005 to read as follows:
1111 Sec. 311.005. WATER WELLS FOR USE BY HOSPITALS IN CERTAIN
1212 COUNTIES IN EVENT OF EMERGENCY OR NATURAL DISASTER. (a) This
1313 section applies only to a hospital located in a county that:
1414 (1) has a population of more than 250,000; and
1515 (2) borders the Neches River.
1616 (b) A hospital to which this section applies may drill a
1717 water well on property owned by the hospital for the purpose of
1818 producing water to supplement the hospital's water supply in the
1919 event that an emergency or natural disaster prevents the hospital
2020 from receiving water from the hospital's usual source.
2121 (c) This section does not affect the authority of a
2222 groundwater conservation district to regulate groundwater
2323 production under Chapter 36, Water Code, or other law governing a
2424 groundwater conservation district.
2525 SECTION 2. This Act takes effect September 1, 2023.
