55 relating to a requirement that certain plats for the subdivision of
66 land include evidence of groundwater supply.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 212.0101, Local Government Code, is
99 amended by amending Subsection (a) and adding Subsections (a-1) and
1010 (a-2) to read as follows:
1111 (a) Except as provided by Subsection (a-1), [If a person
1212 submits] a plat application for the subdivision of a tract of land
1313 for which the source of the water supply intended for the
1414 subdivision is groundwater under that land must[, the municipal
1515 authority responsible for approving plats by ordinance may require
1616 the plat application to] have attached to it a statement that:
1717 (1) is prepared by an engineer licensed to practice in
1818 this state or a geoscientist licensed to practice in this state; and
1919 (2) certifies that adequate groundwater is available
2020 for the subdivision.
2121 (a-1) A municipal authority responsible for approving plats
2222 may waive the requirement prescribed by Subsection (a) that a plat
2323 application have attached to it a statement described by that
2424 subsection if:
2525 (1) based on credible evidence of groundwater
2626 availability in the vicinity of the proposed subdivision, the
2727 municipal authority determines that sufficient groundwater is
2828 available and will continue to be available to the subdivided tract
2929 of land; and
3030 (2) either:
3131 (A) the entire tract proposed to be subdivided by
3232 the plat will be supplied with groundwater from the Gulf Coast
3333 Aquifer or the Carrizo-Wilcox Aquifer; or
3434 (B) the proposed subdivision divides the tract
3535 into not more than 10 parts.
3636 (a-2) A person subject to a waiver authorized by Subsection
3737 (a-1)(2)(B) regarding a subdivided tract of land must comply with
3838 the requirements of Subsection (a) if:
3939 (1) the tract is subsequently divided in a manner that
4040 results in the original tract being subdivided into more than 10
4141 parts; or
4242 (2) the municipal authority determines that the
4343 proposed subdivision is part of a series of proposed subdivisions
4444 from an original tract that collectively includes more than 10
4545 parts.
4646 SECTION 2. Section 232.0032, Local Government Code, is
4747 amended by amending Subsection (a) and adding Subsections (a-1) and
4848 (a-2) to read as follows:
4949 (a) Except as provided by Subsection (a-1), [If a person
5050 submits] a plat application for the subdivision of a tract of land
5151 for which the source of the water supply intended for the
5252 subdivision is groundwater under that land must[, the commissioners
5353 court of a county by order may require the plat application to] have
5454 attached to it a statement that:
5555 (1) is prepared by an engineer licensed to practice in
5656 this state or a geoscientist licensed to practice in this state; and
5757 (2) certifies that adequate groundwater is available
5858 for the subdivision.
5959 (a-1) A commissioners court may waive the requirement
6060 prescribed by Subsection (a) that a plat application have attached
6161 to it a statement described by that subsection if:
6262 (1) based on credible evidence of groundwater
6363 availability in the vicinity of the proposed subdivision, the
6464 commissioners court determines that sufficient groundwater is
6565 available and will continue to be available to the subdivided tract
6666 of land; and
6767 (2) either:
6868 (A) the entire tract proposed to be subdivided by
6969 the plat will be supplied with groundwater from the Gulf Coast
7070 Aquifer or the Carrizo-Wilcox Aquifer; or
7171 (B) the proposed subdivision divides the tract
7272 into not more than 10 parts.
7373 (a-2) A person subject to a waiver authorized by Subsection
7474 (a-1)(2)(B) regarding a subdivided tract of land must comply with
7575 the requirements of Subsection (a) if:
7676 (1) the tract is subsequently divided in a manner that
7777 results in the original tract being subdivided into more than 10
7878 parts; or
7979 (2) the commissioners court determines that the
8080 proposed subdivision is part of a series of proposed subdivisions
8181 from an original tract that collectively includes more than 10
8282 parts.
8383 SECTION 3. The changes in law made by this Act apply only to
8484 a plat application filed on or after the effective date of this Act.
8585 A plat application filed before the effective date of this Act is
8686 governed by the law in effect on the date the application was filed,
8787 and the former law is continued in effect for that purpose.
8888 SECTION 4. This Act takes effect January 1, 2024.
