99 A BILL TO BE ENTITLED
1010 AN ACT
1111 relating to eligibility requirements under the owner-builder loan
1212 program.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 2306.753(b), Government Code, is amended
1515 to read as follows:
1616 (b) To be eligible for a loan under this subchapter, an
1717 owner-builder:
1818 (1) may not have an annual income that exceeds 80 [60]
1919 percent, as determined by the department, of the greater of the
2020 state or local median family income, when combined with the income
2121 of any person who resides with the owner-builder;
2222 (2) must have resided in this state for the preceding
2323 six months;
2424 (3) must have successfully completed an owner-builder
2525 education class under Section 2306.756; and
2626 (4) must agree to:
2727 (A) provide through personal labor at least 65
2828 percent of the labor necessary to build or rehabilitate the
2929 proposed housing by working through a state-certified
3030 owner-builder housing program;
3131 (B) provide an amount of personal labor
3232 equivalent to the amount required under Paragraph (A) in connection
3333 with building or rehabilitating housing for others through a
3434 state-certified owner-builder housing program;
3535 (C) provide through the noncontract labor of
3636 friends, family, or volunteers and through personal labor at least
3737 65 percent of the labor necessary to build or rehabilitate the
3838 proposed housing by working through a state-certified
3939 owner-builder housing program; or
4040 (D) if due to documented disability or other
4141 limiting circumstances as defined by department rule the
4242 owner-builder cannot provide the amount of personal labor otherwise
4343 required by this subdivision, provide through the noncontract labor
4444 of friends, family, or volunteers at least 65 percent of the labor
4545 necessary to build or rehabilitate the proposed housing by working
4646 through a state-certified owner-builder housing program.
4747 SECTION 2. This Act takes effect immediately if it receives
4848 a vote of two-thirds of all the members elected to each house, as
4949 provided by Section 39, Article III, Texas Constitution. If this
5050 Act does not receive the vote necessary for immediate effect, this
5151 Act takes effect September 1, 2023.
