7	7	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	8	SECTION 1. Subtitle C, Title 4, Special District Local Laws
9	9	Code, is amended by adding Chapter 3796 to read as follows:
10	10	CHAPTER 3796. HONEY CREEK IMPROVEMENT DISTRICT NO. 1
11	11	SUBCHAPTER A. GENERAL PROVISIONS
12	12	Sec. 3796.0101. DEFINITIONS. In this chapter:
13	13	(1) "Board" means the district's board of directors.
14	14	(2) "City" means the City of McKinney.
15	15	(3) "Development agreement" means a development
16	16	agreement between the city and a developer of lands in the district
17	17	that establishes the standards that apply to development in the
18	18	district.
19	19	(4) "Director" means a board member.
20	20	(5) "District" means the Honey Creek Improvement
21	21	District No. 1.
22	22	Sec. 3796.0102. NATURE OF DISTRICT. The Honey Creek
23	23	Improvement District No. 1 is a special district created under
24	24	Section 59, Article XVI, Texas Constitution.
25	25	Sec. 3796.0103. PURPOSE; DECLARATION OF INTENT. (a) The
26	26	creation of the district is essential to accomplish the purposes of
27	27	Sections 52 and 52-a, Article III, and Section 59, Article XVI,
28	28	Texas Constitution, and other public purposes stated in this
29	29	chapter.
30	30	(b) By creating the district and in authorizing the city and
31	31	other political subdivisions to contract with the district, the
32	32	legislature has established a program to accomplish the public
33	33	purposes set out in Section 52-a, Article III, Texas Constitution.
34	34	(c) The creation of the district is necessary to promote,
35	35	develop, encourage, and maintain employment, commerce,
36	36	transportation, housing, tourism, recreation, the arts,
37	37	entertainment, economic development, safety, and the public
38	38	welfare in the district.
39	39	(d) This chapter and the creation of the district may not be
40	40	interpreted to relieve the city from providing the level of
41	41	services provided as of the effective date of the Act enacting this
42	42	chapter to the area in the district. The district is created to
43	43	supplement and not to supplant city services provided in the
44	44	district.
45	45	Sec. 3796.0104. FINDINGS OF BENEFIT AND PUBLIC PURPOSE.
46	46	(a) All land and other property included in the district will
47	47	benefit from the improvements and services to be provided by the
48	48	district under powers conferred by Sections 52 and 52-a, Article
49	49	III, and Section 59, Article XVI, Texas Constitution, and other
50	50	powers granted under this chapter.
51	51	(b) The district is created to serve a public use and
52	52	benefit.
53	53	(c) The creation of the district is in the public interest
54	54	and is essential to further the public purposes of:
55	55	(1) developing and diversifying the economy of the
56	56	state;
57	57	(2) eliminating unemployment and underemployment; and
58	58	(3) developing or expanding transportation and
59	59	commerce.
60	60	(d) The district will:
61	61	(1) promote the health, safety, and general welfare of
62	62	residents, employers, potential employees, employees, visitors,
63	63	and consumers in the district, and of the public;
64	64	(2) provide needed funding for the district to
65	65	preserve, maintain, and enhance the economic health and vitality of
66	66	the district territory as a community and business center;
67	67	(3) promote the health, safety, welfare, and enjoyment
68	68	of the public by providing pedestrian ways and by landscaping and
69	69	developing certain areas in the district, which are necessary for
70	70	the restoration, preservation, and enhancement of scenic beauty;
71	71	and
72	72	(4) provide for water, wastewater, drainage, road, and
73	73	recreational facilities for the district.
74	74	(e) Pedestrian ways along or across a street, whether at
75	75	grade or above or below the surface, and street lighting, street
76	76	landscaping, parking, and street art objects are parts of and
77	77	necessary components of a street and are considered to be a street
78	78	or road improvement.
79	79	(f) The district will not act as the agent or
80	80	instrumentality of any private interest even though the district
81	81	will benefit many private interests as well as the public.
82	82	Sec. 3796.0105. INITIAL DISTRICT TERRITORY. (a) The
83	83	district is initially composed of the territory described by
84	84	Section 2 of the Act enacting this chapter.
85	85	(b) The boundaries and field notes contained in Section 2 of
86	86	the Act enacting this chapter form a closure. A mistake in the
87	87	field notes or in copying the field notes in the legislative process
88	88	does not affect the district's:
89	89	(1) organization, existence, or validity;
90	90	(2) right to issue any type of bonds for the purposes
91	91	for which the district is created or to pay the principal of and
92	92	interest on the bonds;
93	93	(3) right to impose or collect an assessment; or
94	94	(4) legality or operation.
95	95	Sec. 3796.0106. ELIGIBILITY FOR INCLUSION IN SPECIAL ZONES.
96	96	All or any part of the area of the district is eligible to be
97	97	included in:
98	98	(1) a tax increment reinvestment zone created under
99	99	Chapter 311, Tax Code; or
100	100	(2) a tax abatement reinvestment zone created under
101	101	Chapter 312, Tax Code.
102	102	Sec. 3796.0107. APPLICABILITY OF MUNICIPAL MANAGEMENT
103	103	DISTRICTS LAW. Except as otherwise provided by this chapter,
104	104	Chapter 375, Local Government Code, applies to the district.
105	105	Sec. 3796.0108. PRECONDITION; EXPIRATION. (a) The
106	106	district may not exercise any powers under this chapter until the
107	107	development agreement is executed. After the development agreement
108	108	is executed, the district shall notify the Texas Commission on
109	109	Environmental Quality of the date the agreement was executed.
110	110	(b) This chapter, including Section 3796.0503, expires
111	111	September 1, 2024, if the development agreement is not executed by
112	112	that date.
113	113	Sec. 3796.0109. CONSTRUCTION OF CHAPTER. This chapter
114	114	shall be liberally construed in conformity with the findings and
115	115	purposes stated in this chapter.
116	116	SUBCHAPTER B. BOARD OF DIRECTORS
117	117	Sec. 3796.0201. GOVERNING BODY; TERMS. (a) The district is
118	118	governed by a board of five elected directors who serve staggered
119	119	terms of four years.
120	120	(b) Directors are elected in the manner provided by
121	121	Subchapter D, Chapter 49, Water Code.
122	122	Sec. 3796.0202. COMPENSATION; EXPENSES. (a) The district
123	123	may compensate each director in an amount not to exceed $150 for
124	124	each board meeting. The total amount of compensation for each
125	125	director in one year may not exceed $7,200.
126	126	(b) A director is entitled to reimbursement for necessary
127	127	and reasonable expenses incurred in carrying out the duties and
128	128	responsibilities of the board.
129	129	Sec. 3796.0203. INITIAL DIRECTORS. (a) The initial board
130	130	consists of the following directors:

143	143	(b) Of the initial directors, the terms of directors
144	144	appointed for positions one through three expire June 1, 2025, and
145	145	the terms of directors appointed for positions four and five expire
146	146	June 1, 2027.
147	147	SUBCHAPTER C. POWERS AND DUTIES
148	148	Sec. 3796.0301. GENERAL POWERS AND DUTIES. The district
149	149	has the powers and duties necessary to accomplish the purposes for
150	150	which the district is created.
151	151	Sec. 3796.0302. IMPROVEMENT PROJECTS AND SERVICES. (a) The
152	152	district, using any money available to the district for the
153	153	purpose, may provide, design, construct, acquire, improve,
154	154	relocate, operate, maintain, or finance an improvement project or
155	155	service authorized under a development agreement described by
156	156	Section 3796.0108, under this chapter, or under Chapter 375, Local
157	157	Government Code.
158	158	(b) The district may contract with a governmental or private
159	159	entity to carry out an action under Subsection (a).
160	160	(c) The implementation of a district project or service is a
161	161	governmental function or service for the purposes of Chapter 791,
162	162	Government Code.
163	163	Sec. 3796.0303. NONPROFIT CORPORATION. (a) The board by
164	164	resolution may authorize the creation of a nonprofit corporation to
165	165	assist and act for the district in implementing a project or
166	166	providing a service authorized by this chapter.
167	167	(b) The nonprofit corporation:
168	168	(1) has each power of and is considered to be a local
169	169	government corporation created under Subchapter D, Chapter 431,
170	170	Transportation Code; and
171	171	(2) may implement any project and provide any service
172	172	authorized by this chapter.
173	173	(c) The board shall appoint the board of directors of the
174	174	nonprofit corporation. The board of directors of the nonprofit
175	175	corporation shall serve in the same manner as the board of directors
176	176	of a local government corporation created under Subchapter D,
177	177	Chapter 431, Transportation Code, except that a board member is not
178	178	required to reside in the district.
179	179	Sec. 3796.0304. MEMBERSHIP IN CHARITABLE ORGANIZATIONS.
180	180	The district may join and pay dues to a charitable or nonprofit
181	181	organization that performs a service or provides an activity
182	182	consistent with the furtherance of a district purpose.
183	183	Sec. 3796.0305. PARKING FACILITIES. (a) The district may
184	184	acquire, lease as lessor or lessee, construct, develop, own,
185	185	operate, and maintain parking facilities or a system of parking
186	186	facilities, including lots, garages, parking terminals, or other
187	187	structures or accommodations for parking motor vehicles off the
188	188	streets and related appurtenances.
189	189	(b) The district's parking facilities serve the public
190	190	purposes of the district and are owned, used, and held for a public
191	191	purpose even if leased or operated by a private entity for a term of
192	192	years.
193	193	(c) The district's parking facilities are parts of and
194	194	necessary components of a street and are considered to be a street
195	195	or road improvement.
196	196	(d) The development and operation of the district's parking
197	197	facilities may be considered an economic development program.
198	198	Sec. 3796.0306. ADDING OR EXCLUDING LAND. (a) Subject to
199	199	Subsection (b), the district may add or exclude land in the manner
200	200	provided by Subchapter J, Chapter 49, Water Code, or by Subchapter
201	201	H, Chapter 54, Water Code.
202	202	(b) The district may add territory as described by
203	203	Subsection (a) only if the governing body of the city by ordinance
204	204	or resolution consents to the addition.
205	205	Sec. 3796.0307. DISBURSEMENTS AND TRANSFERS OF MONEY. The
206	206	board by resolution shall establish the number of directors'
207	207	signatures and the procedure required for a disbursement or
208	208	transfer of district money.
209	209	Sec. 3796.0308. DIVISION OF DISTRICT. (a) The district may
210	210	be divided into two or more new districts only if the district:
211	211	(1) has no outstanding bonded debt; and
212	212	(2) is not imposing ad valorem taxes.
213	213	(b) This chapter applies to any new district created by the
214	214	division of the district, and a new district has all the powers and
215	215	duties of the district.
216	216	(c) Any new district created by the division of the district
217	217	may not, at the time the new district is created, contain any land
218	218	outside the area described by Section 2 of the Act enacting this
219	219	chapter.
220	220	(d) The board, on its own motion or on receipt of a petition
221	221	signed by the owner or owners of a majority of the assessed value of
222	222	the real property in the district, may adopt an order dividing the
223	223	district.
224	224	(e) An order dividing the district must:
225	225	(1) name each new district;
226	226	(2) include the metes and bounds description of the
227	227	territory of each new district;
228	228	(3) appoint initial directors for each new district;
229	229	and
230	230	(4) provide for the division of assets and liabilities
231	231	between or among the new districts.
232	232	(f) On or before the 30th day after the date of adoption of
233	233	an order dividing the district, the district shall file the order
234	234	with the Texas Commission on Environmental Quality and record the
235	235	order in the real property records of each county in which the
236	236	district is located.
237	237	(g) Municipal consent to the creation of the district and to
238	238	the inclusion of land in the district granted under Section
239	239	3796.0503 acts as municipal consent to the creation of any new
240	240	district created by the division of the district and to the
241	241	inclusion of land in the new district.
242	242	Sec. 3796.0309. CERTAIN RESIDENTIAL PROPERTY NOT EXEMPT.
243	243	Section 375.161, Local Government Code, does not apply to the
244	244	district.
245	245	Sec. 3796.0310. NO AD VALOREM TAX. The district may not
246	246	impose an ad valorem tax.
247	247	Sec. 3796.0311. NO EMINENT DOMAIN POWER. The district may
248	248	not exercise the power of eminent domain.
249	249	SUBCHAPTER D. ASSESSMENTS
250	250	Sec. 3796.0401. PETITION REQUIRED FOR FINANCING SERVICES
251	251	AND IMPROVEMENTS WITH ASSESSMENTS. (a) The board may not finance a
252	252	service or improvement project with assessments under this chapter
253	253	unless a written petition requesting that service or improvement
254	254	has been filed with the board.
255	255	(b) A petition filed under Subsection (a) must be signed by
256	256	the owners of a majority of the assessed value of real property in
257	257	the district subject to assessment according to the most recent
258	258	certified tax appraisal roll for the county.
259	259	Sec. 3796.0402. ASSESSMENTS; LIENS FOR ASSESSMENTS. (a)
260	260	The board by resolution may impose and collect an assessment for any
261	261	purpose authorized by this chapter in all or any part of the
262	262	district.
263	263	(b) An assessment, a reassessment, or an assessment
264	264	resulting from an addition to or correction of the assessment roll
265	265	by the district, penalties and interest on an assessment or
266	266	reassessment, an expense of collection, and reasonable attorney's
267	267	fees incurred by the district:
268	268	(1) are a first and prior lien against the property
269	269	assessed;
270	270	(2) are superior to any other lien or claim other than
271	271	a lien or claim for county, school district, or municipal ad valorem
272	272	taxes; and
273	273	(3) are the personal liability of and a charge against
274	274	the owners of the property even if the owners are not named in the
275	275	assessment proceedings.
276	276	(c) The lien is effective from the date of the board's
277	277	resolution imposing the assessment until the date the assessment is
278	278	paid. The board may enforce the lien in the same manner that a
279	279	taxing unit, as that term is defined by Section 1.04, Tax Code, may
280	280	enforce an ad valorem tax lien against real property.
281	281	(d) The board may make a correction to or deletion from the
282	282	assessment roll that does not increase the amount of assessment of
283	283	any parcel of land without providing notice and holding a hearing in
284	284	the manner required for additional assessments.
285	285	SUBCHAPTER E. BONDS
286	286	Sec. 3796.0501. AUTHORITY TO BORROW MONEY AND TO ISSUE
287	287	BONDS AND OTHER OBLIGATIONS. (a) The district may borrow money on
288	288	terms determined by the board.
289	289	(b) The district may issue, by public or private sale,
290	290	bonds, notes, or other obligations payable wholly or partly from
291	291	assessments, revenue, contract payments, grants, or other district
292	292	money, or any combination of those sources of money, to pay for any
293	293	authorized district purpose.
294	294	(c) The district may issue, by public or private sale,
295	295	bonds, notes, or other obligations payable wholly or partly from
296	296	assessments in the manner provided by Subchapter A, Chapter 372,
297	297	Local Government Code, if the improvement financed by the
298	298	obligation issued under this section will be conveyed to or
299	299	operated and maintained by a municipality or other retail utility
300	300	provider pursuant to an agreement with the district entered into
301	301	before the issuance of the obligation.
302	302	Sec. 3796.0502. BONDS SECURED BY REVENUE OR CONTRACT
303	303	PAYMENTS. The district may issue, without an election, bonds
304	304	secured by:
305	305	(1) revenue other than ad valorem taxes, including
306	306	contract revenues; or
307	307	(2) contract payments, provided that the requirements
308	308	of Section 49.108, Water Code, have been met.
309	309	Sec. 3796.0503. CONSENT OF CITY REQUIRED. The board may not
310	310	issue bonds until the city has consented by ordinance or resolution
311	311	to the creation of the district and to the inclusion of land in the
312	312	district as required by applicable law.
313	313	SUBCHAPTER I. DISSOLUTION
314	314	Sec. 3796.0901. DISSOLUTION. (a) The board shall dissolve
315	315	the district on written petition filed with the board by the owners
316	316	of:
317	317	(1) 50 percent or more of the assessed value of the
318	318	property subject to assessment by the district based on the most
319	319	recent certified county property tax rolls; or
320	320	(2) 50 percent or more of the surface area of the
321	321	district, excluding roads, streets, highways, utility
322	322	rights-of-way, other public areas, and other property exempt from
323	323	assessment by the district according to the most recent certified
324	324	county property tax rolls.
325	325	(b) The district may not be dissolved if the district:
326	326	(1) has any outstanding bonded or other indebtedness
327	327	until that bonded or other indebtedness has been repaid or defeased
328	328	in accordance with the order or resolution authorizing the issuance
329	329	of the bonded or other indebtedness;
330	330	(2) has a contractual obligation to pay money until
331	331	that obligation has been fully paid in accordance with the
332	332	contract; or
333	333	(3) owns, operates, or maintains public works,
334	334	facilities, or improvements unless the district contracts with
335	335	another person for the ownership, operation, or maintenance of the
336	336	public works, facilities, or improvements.
337	337	(c) Section 375.262, Local Government Code, does not apply
338	338	to the district.
339	339	SECTION 2. The Honey Creek Improvement District No. 1
340	340	initially includes all territory contained in the following area:

344	344	BEING a 1218.714 acre tract of land situated in the in the L.D.
345	345	Davidson Survey, Abstract No. 285, the E. Hamilton Survey, Abstract
346	346	No. 372, the W.H. Horn Survey, Abstract No. 1070, the W.M. Rice
347	347	Survey, Abstract No. 770, and the Meredith Hart Survey, Abstract
348	348	No. 371, City of McKinney, Collin County, Texas, and being the
349	349	remainder of a 189.1 acre tract and 1064.2 acre tract of land
350	350	described in a deed to Franklin Family Partnership recorded in
351	351	Volume 5540, Page 826, Land Records, Collin County, Texas, and
352	352	being part of a 3.00 acre tract of land described in a deed to Lela
353	353	M. Fryar recorded in Volume 703, Page 617, Land Records, Collin
354	354	County, Texas, and being all of a 10.00 acre tract of land described
355	355	in a deed to Richard Loren Franklin recorded in Clerk File
356	356	No. 95-0015568 Land Records, Collin County, Texas, and being more
357	357	particularly described as follows:
358	358	COMMENCING at a railroad spike found in asphalt at the intersection
359	359	of the centerline of County Road 166 and County Road 168, said point
360	360	being the apparent intersection of four surveys: the southeast
361	361	corner of the Thomas E. Pelham Survey, Abstract Number 724, the
362	362	southwest corner of the Jno. Cahill Survey, Abstract number 143,
363	363	the northeast corner of said D. J. Franklin Survey, and the
364	364	northwest corner of said L. D. Davidson Survey;
