| 8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 9 | 9 | SECTION 1. Section 31.055, Parks and Wildlife Code, is | |
| 10 | 10 | amended to read as follows: | |
| 11 | 11 | Sec. 31.055. EXCEPTIONS. This subchapter does not apply | |
| 12 | 12 | to: | |
| 13 | 13 | (1) vessels with a valid marine document issued by the | |
| 14 | 14 | United States Coast Guard's National Vessel Documentation Center or | |
| 15 | 15 | a federal agency that is a successor to the National Vessel | |
| 16 | 16 | Documentation Center; or | |
| 17 | 17 | (2) an outboard motor that: | |
| 18 | 18 | (A) is at least 40 years of age; and | |
| 19 | 19 | (B) has a capacity of not more than 25 | |
| 20 | 20 | horsepower. | |
| 21 | 21 | SECTION 2. This Act takes effect September 1, 2023. |
