55 relating to the enforcement of commercial motor vehicle safety
66 standards in certain counties.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 644.101(c), Transportation Code, as
99 amended by Chapters 74 (H.B. 2749) and 429 (S.B. 901), Acts of the
1010 87th Legislature, Regular Session, 2021, is reenacted and amended
1111 to read as follows:
1212 (c) A sheriff or a deputy sheriff of any of the following
1313 counties is eligible to apply for certification under this section:
1414 (1) a county bordering the United Mexican States;
1515 (2) a county with a population of less than 1,000, part
1616 of which is located within 75 miles of an international border;
1717 (3) a county with a population of 700,000 or more;
1818 (4) a county with a population of 400,000 or more that
1919 borders the county in which the State Capitol is located; [or]
2020 (5) a county with a population of less than 250,000
2121 that:
2222 (A) is adjacent to two counties that each have a
2323 population of more than 1.2 million; and
2424 (B) contains two highways that are part of the
2525 national system of interstate and defense highways;
2626 (6) [(5)] a county:
2727 (A) any part of which is within 30 miles of New
2828 Mexico; and
2929 (B) that is adjacent to two or more counties that
3030 generated $100 million or more in tax revenue collected under
3131 Chapters 201 and 202, Tax Code, from oil and gas production during
3232 the preceding state fiscal year; [or]
3333 (7) [(6)] a county with a population of more than
3434 40,000 and less than 300,000 that is adjacent to a county described
3535 by Subdivision (4); or
3636 (8) a county with a population of more than 50,000 and
3737 less than 90,000 that is adjacent to a county with a population of
3838 more than 4,000,000.
3939 SECTION 2. To the extent of any conflict, this Act prevails
4040 over another Act of the 88th Legislature, Regular Session, 2023,
4141 relating to nonsubstantive additions to and corrections in enacted
4242 codes.
4343 SECTION 3. This Act takes effect September 1, 2023.
