44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to fetal development instruction included as part of the
77 public school health curriculum in certain grade levels.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 28.002, Education Code, is amended by
1010 adding Subsection (x) to read as follows:
1111 (x) The State Board of Education shall adopt rules requiring
1212 students enrolled in grade levels seven and eight to receive
1313 instruction on fetal development as part of the essential knowledge
1414 and skills for the health curriculum required under Subsection
1515 (a)(2)(B). The instruction must include:
1616 (1) information on:
1717 (A) the human reproductive process, pregnancy,
1818 and infertility; and
1919 (B) the prevention of birth defects, including
2020 information on the effect of drugs, alcohol, and environmental
2121 hazards such as lead; and
2222 (2) a description of the growth and development of an
2323 unborn child that occur during each trimester of pregnancy.
2424 SECTION 2. Section 28.004(c), Education Code, is amended to
2525 read as follows:
2626 (c) The local school health advisory council's duties
2727 include recommending:
2828 (1) the number of hours of instruction to be provided
2929 in:
3030 (A) health education in kindergarten through
3131 grade eight; and
3232 (B) if the school district requires health
3333 education for high school graduation, health education, including
3434 physical health education and mental health education, in grades 9
3535 through 12;
3636 (2) policies, procedures, strategies, and curriculum
3737 appropriate for specific grade levels designed to prevent physical
3838 health concerns, including obesity, cardiovascular disease, Type 2
3939 diabetes, and mental health concerns, including suicide, through
4040 coordination of:
4141 (A) health education, which must address
4242 physical health concerns and mental health concerns to ensure the
4343 integration of physical health education and mental health
4444 education;
4545 (B) physical education and physical activity;
4646 (C) nutrition services;
4747 (D) parental involvement;
4848 (E) instruction on substance abuse prevention;
4949 (F) school health services, including mental
5050 health services;
5151 (G) a comprehensive school counseling program
5252 under Section 33.005;
5353 (H) a safe and healthy school environment; and
5454 (I) school employee wellness;
5555 (3) appropriate grade levels and methods of
5656 instruction for human sexuality instruction;
5757 (4) strategies for integrating the curriculum
5858 components specified by Subdivision (2) with the following elements
5959 in a coordinated school health program for the district:
6060 (A) school health services, including physical
6161 health services and mental health services, if provided at a campus
6262 by the district or by a third party under a contract with the
6363 district;
6464 (B) a comprehensive school counseling program
6565 under Section 33.005;
6666 (C) a safe and healthy school environment; and
6767 (D) school employee wellness;
6868 (5) if feasible, joint use agreements or strategies
6969 for collaboration between the school district and community
7070 organizations or agencies;
7171 (6) strategies to increase parental awareness
7272 regarding:
7373 (A) risky behaviors and early warning signs of
7474 suicide risks and behavioral health concerns, including mental
7575 health disorders and substance use disorders; and
7676 (B) available community programs and services
7777 that address risky behaviors, suicide risks, and behavioral health
7878 concerns;
7979 (7) appropriate grade levels and curriculum for
8080 instruction regarding opioid addiction and abuse and methods of
8181 administering an opioid antagonist, as defined by Section 483.101,
8282 Health and Safety Code; [and]
8383 (8) appropriate grade levels and curriculum for
8484 instruction regarding child abuse, family violence, dating
8585 violence, and sex trafficking, including likely warning signs that
8686 a child may be at risk for sex trafficking, provided that the local
8787 school health advisory council's recommendations under this
8888 subdivision do not conflict with the essential knowledge and skills
8989 developed by the State Board of Education under this subchapter;
9090 and
9191 (9) appropriate curriculum for the instruction on
9292 fetal development described by Section 28.002(x), provided that the
9393 local school health advisory council's recommendations under this
9494 subdivision do not conflict with the essential knowledge and skills
9595 developed by the State Board of Education under this subchapter.
9696 SECTION 3. This Act applies beginning with the 2023-2024
9797 school year.
9898 SECTION 4. This Act takes effect immediately if it receives
9999 a vote of two-thirds of all the members elected to each house, as
100100 provided by Section 39, Article III, Texas Constitution. If this
101101 Act does not receive the vote necessary for immediate effect, this
102102 Act takes effect September 1, 2023.
