5	5	relating to the enforcement of commercial motor vehicle safety
6	6	standards in certain municipalities.
7	7	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	8	SECTION 1. Section 644.101(b), Transportation Code, is
9	9	amended to read as follows:
10	10	(b) A police officer of any of the following municipalities
11	11	is eligible to apply for certification under this section:
12	12	(1) a municipality with a population of 50,000 or
13	13	more;
14	14	(2) a municipality with a population of 25,000 or more
15	15	any part of which is located in a county with a population of
16	16	500,000 or more;
17	17	(3) a municipality with a population of less than
18	18	25,000:
19	19	(A) any part of which is located in a county with
20	20	a population of 3.3 million; and
21	21	(B) that contains or is adjacent to an
22	22	international port;
23	23	(4) a municipality with a population of at least
24	24	34,000 that is located in a county that borders two or more states;
25	25	(5) a municipality any part of which is located in a
26	26	county bordering the United Mexican States;
27	27	(6) a municipality with a population of less than
28	28	5,000 that is located:
29	29	(A) adjacent to a bay connected to the Gulf of
30	30	Mexico; and
31	31	(B) in a county adjacent to a county with a
32	32	population greater than 3.3 million;
33	33	(7) a municipality that is located:
34	34	(A) within 25 miles of an international port; and
35	35	(B) in a county that does not contain a highway
36	36	that is part of the national system of interstate and defense
37	37	highways and is adjacent to a county with a population greater than
38	38	3.3 million;
39	39	(8) a municipality with a population of less than
40	40	8,500 that:
41	41	(A) is the county seat; and
42	42	(B) contains a highway that is part of the
43	43	national system of interstate and defense highways;
44	44	(9) a municipality located in a county with a
45	45	population between 60,000 and 66,000 adjacent to a bay connected to
46	46	the Gulf of Mexico;
47	47	(10) a municipality with a population of more than
48	48	40,000 and less than 50,000 that is located in a county with a
49	49	population of more than 285,000 and less than 300,000 that borders
50	50	the Gulf of Mexico;
51	51	(11) a municipality with a population between 32,000
52	52	and 50,000 that is located entirely in a county that:
53	53	(A) has a population of less than 250,000;
54	54	(B) is adjacent to two counties that each have a
55	55	population of more than 1.2 million; and
56	56	(C) contains two highways that are part of the
57	57	national system of interstate and defense highways;
58	58	(12) a municipality with a population of more than
59	59	3,000 and less than 10,000 that:
60	60	(A) contains a highway that is part of the
61	61	national system of interstate and defense highways; and
62	62	(B) is located in a county with a population
63	63	between 150,000 and 155,000;
64	64	(13) a municipality with a population of less than
65	65	75,000 that is located in three counties, at least one of which has
66	66	a population greater than 3.3 million;
67	67	(14) a municipality with a population between 14,000
68	68	and 17,000 that:
69	69	(A) contains three or more numbered United States
70	70	highways; and
71	71	(B) is located in a county that is adjacent to a
72	72	county with a population of more than 200,000; [or]
73	73	(15) a municipality with a population of less than
74	74	50,000 that is located in:
75	75	(A) a county that generated $20 million or more
76	76	in tax revenue collected under Chapters 201 and 202, Tax Code, from
77	77	oil and gas production during the preceding state fiscal year; or
78	78	(B) a county that is adjacent to two or more
79	79	counties described by Paragraph (A); or
80	80	(16) a municipality that is located:
81	81	(A) within 20 miles of an international airport;
82	82	and
83	83	(B) in a county that:
84	84	(i) contains an active quarry;
85	85	(ii) has a population of more than 150,000
86	86	but less than 170,000; and
87	87	(iii) is adjacent to a county with a
88	88	population of more than two million.
89	89	SECTION 2. This Act takes effect September 1, 2023.
