66 AN ACT
77 relating to the barring of certain vendors from participation in
88 contracts with the state or a political subdivision and to
99 prohibiting the use of technologies manufactured or sold by certain
1010 of those vendors.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subtitle A, Title 6, Government Code, is amended
1313 by adding Chapter 620 to read as follows:
1414 CHAPTER 620. USE OF CERTAIN TECHNOLOGIES BY GOVERNMENTAL ENTITY
1515 PROHIBITED
1616 Sec. 620.001. DEFINITION. In this chapter, "governmental
1717 entity" means:
1818 (1) a department, commission, board, office, or other
1919 agency that is in the executive or legislative branch of state
2020 government and that was created by the constitution or a statute,
2121 including an institution of higher education as defined by Section
2222 61.003, Education Code;
2323 (2) the supreme court, the court of criminal appeals,
2424 a court of appeals, or the Texas Judicial Council or another agency
2525 in the judicial branch of state government; or
2626 (3) a political subdivision of this state, including a
2727 municipality, county, or special purpose district.
2828 Sec. 620.002. PROHIBITION. A governmental entity shall
2929 adopt a policy prohibiting the installation or use by the
3030 governmental entity of a technology manufactured or sold by an
3131 entity prohibited from participating in federal contracts under
3232 Section 889, John S. McCain National Defense Authorization Act for
3333 Fiscal Year 2019 (Pub. L. No. 115-232), as it existed on January 1,
3434 2023.
3535 SECTION 2. Section 2155.077, Government Code, is amended by
3636 adding Subsection (a-3) to read as follows:
3737 (a-3) The comptroller shall bar a vendor from participating
3838 in state contracts that are subject to this subtitle, including
3939 contracts for which purchasing authority is delegated to a state
4040 agency, if the vendor:
4141 (1) is prohibited from participating in federal
4242 contracts under Section 889, John S. McCain National Defense
4343 Authorization Act for Fiscal Year 2019 (Pub. L. No. 115-232), as it
4444 existed on January 1, 2023;
4545 (2) contracts with an entity described by Subdivision
4646 (1) to provide products or services to this state; or
4747 (3) is designated as a risk to state security by the
4848 Homeland Security Council, with advice from the governor, unless
4949 the federal government has determined that the vendor does not pose
5050 a risk to national security.
5151 SECTION 3. Subchapter Z, Chapter 271, Local Government
5252 Code, is amended by adding Section 271.909 to read as follows:
5353 Sec. 271.909. BARRING CERTAIN VENDORS FROM PARTICIPATION IN
5454 CONTRACTS. The governing body of a political subdivision by
5555 ordinance, order, or other measure shall bar a vendor from
5656 participating in contracts with the political subdivision if the
5757 vendor:
5858 (1) is prohibited from participating in federal
5959 contracts under Section 889, John S. McCain National Defense
6060 Authorization Act for Fiscal Year 2019 (Pub. L. No. 115-232), as it
6161 existed on January 1, 2023;
6262 (2) contracts with an entity described by Subdivision
6363 (1) to provide products or services to this state; or
6464 (3) is designated as a risk to state security by the
6565 Homeland Security Council, with advice from the governor, unless
6666 the federal government has determined that the vendor does not pose
6767 a risk to national security.
6868 SECTION 4. Section 421.026, Government Code, is amended to
6969 read as follows:
7070 Sec. 421.026. REPORTS [REPORT]. (a) The council shall
7171 annually submit to the governor a report stating:
7272 (1) the status and funding of state programs designed
7373 to detect and deter homeland security emergencies, including the
7474 status and funding of counterterrorism efforts;
7575 (2) recommendations on actions to reduce threats to
7676 homeland security, including threats related to terrorism; and
7777 (3) recommendations for improving the alert,
7878 response, and recovery capabilities of state and local agencies.
7979 (b) The council shall submit a report to the legislature
8080 identifying each vendor designated as a risk to state security for
8181 purposes of barring the vendor from participating in contracts
8282 under Section 2155.077(a-3)(3) of this code and Section 271.909(3),
8383 Local Government Code. The council shall submit an update to the
8484 report under this subsection each time the council designates a
8585 vendor as a risk to state security.
8686 SECTION 5. Not later than November 1, 2023, each
8787 governmental entity shall adopt the policy required by Chapter 620,
8888 Government Code, as added by this Act.
8989 SECTION 6. The changes in law made by this Act apply only to
9090 a contract for which a state agency or political subdivision first
9191 advertises or otherwise solicits offers, bids, proposals,
9292 qualifications, or other applicable expressions of interest on or
9393 after the effective date of this Act. A contract for which a state
9494 agency or political subdivision first advertises or otherwise
9595 solicits offers, bids, proposals, qualifications, or other
9696 applicable expressions of interest before the effective date of
9797 this Act is governed by the law as it existed immediately before the
9898 effective date of this Act, and that law is continued in effect for
9999 that purpose.
100100 SECTION 7. This Act takes effect September 1, 2023.
