55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the designation of liaison officers to assist certain
88 students at public institutions of higher education who are
99 parents.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter Z, Chapter 51, Education Code, is
1212 amended by adding Section 51.9357 to read as follows:
1313 Sec. 51.9357. DESIGNATION OF LIAISON OFFICER TO ASSIST
1414 CERTAIN STUDENTS WHO ARE PARENTS; REPORT. (a) In this section:
1515 (1) "Coordinating board" means the Texas Higher
1616 Education Coordinating Board.
1717 (2) "Institution of higher education" has the meaning
1818 assigned by Section 61.003.
1919 (b) Each institution of higher education shall designate at
2020 least one employee of the institution to act as a liaison officer
2121 for current or incoming students at the institution who are the
2222 parent or guardian of a child younger than 18 years of age. The
2323 liaison officer shall provide to the students information regarding
2424 support services and other resources available to the students at
2525 the institution, including:
2626 (1) resources to access:
2727 (A) medical and behavioral health coverage and
2828 services; and
2929 (B) public benefit programs, including programs
3030 related to food security, affordable housing, and housing
3131 subsidies;
3232 (2) parenting and child care resources;
3333 (3) employment assistance;
3434 (4) transportation assistance;
3535 (5) student academic success strategies; and
3636 (6) any other resources developed by the institution
3737 to assist the students.
3838 (c) Not later than May 1 of each academic year, an
3939 institution of higher education shall submit to the coordinating
4040 board a report that contains the following information regarding
4141 students enrolled at the institution for the current academic year
4242 who are the parent or guardian of a child younger than 18 years of
4343 age:
4444 (1) the number of those students;
4545 (2) demographic data, including age, race, sex,
4646 ethnicity, and national origin;
4747 (3) academic data, including full-time or part-time
4848 enrollment status and graduation, transfer, and withdrawal rates;
4949 and
5050 (4) other data as prescribed by coordinating board
5151 rule.
5252 (d) The coordinating board shall adopt rules to administer
5353 this section, including rules to ensure compliance with federal law
5454 regarding confidentiality of student medical or educational
5555 information, including the Health Insurance Portability and
5656 Accountability Act of 1996 (42 U.S.C. Section 1320d et seq.), the
5757 Family Educational Rights and Privacy Act of 1974 (20 U.S.C.
5858 Section 1232g), and any state law relating to the privacy of student
5959 information.
6060 SECTION 2. Subchapter C, Chapter 61, Education Code, is
6161 amended by adding Section 61.09081 to read as follows:
6262 Sec. 61.09081. DESIGNATION OF LIAISON OFFICER TO ASSIST
6363 CERTAIN STUDENTS WHO ARE PARENTS. The board shall designate at
6464 least one employee of the board to act as a liaison officer for
6565 current or incoming students at institutions of higher education
6666 who are the parent or guardian of a child younger than 18 years of
6767 age. The liaison officer shall assist in coordinating college
6868 readiness and student success efforts relating to those students.
6969 SECTION 3. (a) As soon as practicable after the effective
7070 date of this Act, the Texas Higher Education Coordinating Board
7171 shall adopt rules to implement Sections 51.9357 and 61.09081,
7272 Education Code, as added by this Act.
7373 (b) This Act applies beginning with the 2023-2024 academic
7474 year.
7575 SECTION 4. This Act takes effect immediately if it receives
7676 a vote of two-thirds of all the members elected to each house, as
7777 provided by Section 39, Article III, Texas Constitution. If this
7878 Act does not receive the vote necessary for immediate effect, this
7979 Act takes effect September 1, 2023.
