66 AN ACT
77 relating to school marshals, including eligibility for appointment
88 as a school marshal, licensure and training requirements, and
99 school marshal uniforms or badges.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Article 2.127(d), Code of Criminal Procedure, is
1212 amended to read as follows:
1313 (d) A person may not serve as a school marshal unless the
1414 person is:
1515 (1) licensed:
1616 (A) as a peace officer under Chapter 1701,
1717 Occupations Code; or
1818 (B) under Section 1701.260, Occupations Code;
1919 and
2020 (2) appointed by:
2121 (A) the board of trustees of a school district or
2222 the governing body of an open-enrollment charter school under
2323 Section 37.0811, Education Code;
2424 (B) the governing body of a private school under
2525 Section 37.0813, Education Code; or
2626 (C) the governing board of a public junior
2727 college under Section 51.220, Education Code.
2828 SECTION 2. Section 37.0811, Education Code, is amended by
2929 amending Subsections (b), (f), and (h) and adding Subsections
3030 (b-1), (i), and (j) to read as follows:
3131 (b) The board of trustees of a school district or the
3232 governing body of an open-enrollment charter school may select for
3333 appointment as a school marshal under this section an applicant who
3434 is:
3535 (1) either:
3636 (A) an employee of the school district or
3737 open-enrollment charter school; or
3838 (B) a school district or open-enrollment charter
3939 school volunteer who is:
4040 (i) an honorably discharged veteran or
4141 active duty member of the armed forces of the United States;
4242 (ii) a peace officer;
4343 (iii) a reserve law enforcement officer, as
4444 defined by Section 1701.001, Occupations Code; or
4545 (iv) a retired peace officer, as defined by
4646 Section 1701.3161, Occupations Code; and
4747 (2) either:
4848 (A) certified as eligible for appointment under
4949 Section 1701.260, Occupations Code; or
5050 (B) licensed as a peace officer under Chapter
5151 1701, Occupations Code.
5252 (b-1) The board of trustees of a school district or the
5353 governing body of an open-enrollment charter school may, but shall
5454 not be required to, reimburse the amount paid by an [the] applicant
5555 for appointment as a school marshal to participate in the training
5656 program under Section 1701.260, Occupations Code [that section].
5757 (f) A person's [school district or charter school
5858 employee's] status as a school marshal becomes inactive on:
5959 (1) expiration of the person's [employee's] school
6060 marshal license under Section 1701.260, Occupations Code, or peace
6161 officer license under Chapter 1701, Occupations Code, as
6262 applicable;
6363 (2) suspension or revocation of the person's
6464 [employee's] license to carry a handgun issued under Subchapter H,
6565 Chapter 411, Government Code, if the person is licensed as a school
6666 marshal under Section 1701.260, Occupations Code;
6767 (3) termination of the person's [employee's]
6868 employment or volunteer service, as applicable, with the district
6969 or charter school; or
7070 (4) notice from the board of trustees of the district
7171 or the governing body of the charter school that the person's
7272 [employee's] services as school marshal are no longer required.
7373 (h) If a parent or guardian of a student enrolled at a school
7474 inquires in writing, the school district or open-enrollment charter
7575 school shall provide the parent or guardian written notice
7676 indicating whether any person [employee of the school] is currently
7777 appointed a school marshal. The notice may not disclose
7878 information that is confidential under Subsection (g).
7979 (i) The board of trustees of a school district or the
8080 governing body of an open-enrollment charter school may require or
8181 authorize a person appointed school marshal to wear a distinctive
8282 uniform or badge indicating the person's status as a school
8383 marshal.
8484 (j) A school district or open-enrollment charter school
8585 shall provide to each newly appointed school marshal training
8686 specific to the campus at which the school marshal is employed or
8787 volunteers that includes:
8888 (1) an overview of campus grounds and facilities;
8989 (2) daily schedules;
9090 (3) the district's or school's multihazard emergency
9191 operations plan adopted under Section 37.108; and
9292 (4) the contact information for any person to be
9393 notified in the event of an emergency or a nonemergency incident.
9494 SECTION 3. Section 37.0813, Education Code, is amended by
9595 amending Subsections (b), (f), and (h) and adding Subsections (j)
9696 and (k) to read as follows:
9797 (b) The governing body of a private school may select for
9898 appointment as a school marshal under this section an applicant who
9999 is:
100100 (1) either:
101101 (A) an employee of the school; or
102102 (B) a school volunteer who is:
103103 (i) an honorably discharged veteran or
104104 active duty member of the armed forces of the United States;
105105 (ii) a peace officer;
106106 (iii) a reserve law enforcement officer, as
107107 defined by Section 1701.001, Occupations Code; or
108108 (iv) a retired peace officer, as defined by
109109 Section 1701.3161, Occupations Code; and
110110 (2) either:
111111 (A) certified as eligible for appointment under
112112 Section 1701.260, Occupations Code; or
113113 (B) licensed as a peace officer under Chapter
114114 1701, Occupations Code.
115115 (f) A person's [private school employee's] status as a
116116 school marshal becomes inactive on:
117117 (1) expiration of the person's [employee's] school
118118 marshal license under Section 1701.260, Occupations Code, or peace
119119 officer license under Chapter 1701, Occupations Code, as
120120 applicable;
121121 (2) suspension or revocation of the person's
122122 [employee's] license to carry a handgun issued under Subchapter H,
123123 Chapter 411, Government Code, if the person is licensed as a school
124124 marshal under Section 1701.260, Occupations Code;
125125 (3) termination of the person's [employee's]
126126 employment or volunteer service, as applicable, with the private
127127 school; or
128128 (4) notice from the governing body that the person's
129129 [employee's] services as school marshal are no longer required.
130130 (h) If a parent or guardian of a student enrolled at a
131131 private school inquires in writing, the school shall provide the
132132 parent or guardian written notice indicating whether any person
133133 [employee of the school] is currently appointed a school marshal.
134134 The notice may not disclose information that is confidential under
135135 Subsection (g).
136136 (j) The governing body of a private school may require or
137137 authorize a person appointed school marshal to wear a distinctive
138138 uniform or badge indicating the person's status as a school
139139 marshal.
140140 (k) A private school shall provide to each newly appointed
141141 school marshal training specific to the campus at which the school
142142 marshal is employed or volunteers that includes:
143143 (1) an overview of campus grounds and facilities;
144144 (2) daily schedules;
145145 (3) any emergency operations plan adopted by the
146146 school; and
147147 (4) the contact information for any person to be
148148 notified in the event of an emergency or a nonemergency incident.
149149 SECTION 4. Section 51.220, Education Code, is amended by
150150 amending Subsections (c), (g), and (i) and adding Subsections
151151 (c-1), (j), and (k) to read as follows:
152152 (c) The governing board of a public junior college may
153153 select for appointment as a school marshal under this section an
154154 applicant who is:
155155 (1) either:
156156 (A) an employee of the public junior college; or
157157 (B) a volunteer of the public junior college who
158158 is:
159159 (i) an honorably discharged veteran or
160160 active duty member of the armed forces of the United States;
161161 (ii) a peace officer;
162162 (iii) a reserve law enforcement officer, as
163163 defined by Section 1701.001, Occupations Code; or
164164 (iv) a retired peace officer, as defined by
165165 Section 1701.3161, Occupations Code; and
166166 (2) either:
167167 (A) certified as eligible for appointment under
168168 Section 1701.260, Occupations Code; or
169169 (B) licensed as a peace officer under Chapter
170170 1701, Occupations Code.
171171 (c-1) The governing board of a public junior college may,
172172 but shall not be required to, reimburse the amount paid by an [the]
173173 applicant for appointment as a school marshal to participate in the
174174 training program under Section 1701.260, Occupations Code [that
175175 section].
176176 (g) A person's [public junior college employee's] status as
177177 a school marshal becomes inactive on:
178178 (1) expiration of the person's [employee's] school
179179 marshal license under Section 1701.260, Occupations Code, or peace
180180 officer license under Chapter 1701, Occupations Code, as
181181 applicable;
182182 (2) suspension or revocation of the person's
183183 [employee's] license to carry a concealed handgun issued under
184184 Subchapter H, Chapter 411, Government Code, if the person is
185185 licensed as a school marshal under Section 1701.260, Occupations
186186 Code;
187187 (3) termination of the person's [employee's]
188188 employment or volunteer service, as applicable, with the public
189189 junior college; or
190190 (4) notice from the governing board of the public
191191 junior college that the person's [employee's] services as school
192192 marshal are no longer required.
193193 (i) If a parent or guardian of a student enrolled at a public
194194 junior college inquires in writing, the governing board of the
195195 public junior college shall provide the parent or guardian written
196196 notice indicating whether any person [employee of the public junior
197197 college] is currently appointed a school marshal. The notice may
198198 not disclose information that is confidential under Subsection (h).
199199 (j) The governing body of a public junior college may
200200 require or authorize a person appointed school marshal to wear a
201201 distinctive uniform or badge indicating the person's status as a
202202 school marshal.
203203 (k) A public junior college shall provide to each newly
204204 appointed school marshal training specific to the campus at which
205205 the school marshal is employed or volunteers that includes:
206206 (1) an overview of campus grounds and facilities;
207207 (2) daily schedules;
208208 (3) the college's multihazard emergency operations
209209 plan adopted under Section 37.108; and
210210 (4) the contact information for any person to be
211211 notified in the event of an emergency or a nonemergency incident.
212212 SECTION 5. Section 1701.001(8), Occupations Code, is
213213 amended to read as follows:
214214 (8) "School marshal" means a person who:
215215 (A) is appointed to serve as a school marshal by:
216216 (i) the board of trustees of a school
217217 district or the governing body of an open-enrollment charter school
218218 under Section 37.0811, Education Code;
219219 (ii) the governing body of a private school
220220 under Section 37.0813, Education Code; or
221221 (iii) the governing board of a public
222222 junior college under Section 51.220, Education Code;
223223 (B) is licensed:
224224 (i) as a peace officer under this chapter;
225225 or
226226 (ii) under Section 1701.260; and
227227 (C) has powers and duties described by Article
228228 2.127, Code of Criminal Procedure.
229229 SECTION 6. Section 1701.260, Occupations Code, is amended
230230 by amending Subsections (a), (b), and (j) and adding Subsection
231231 (f-1) to read as follows:
232232 (a) The commission shall establish and maintain a training
233233 program open to any employee or school volunteer of a school
234234 district, open-enrollment charter school, private school, or
235235 public junior college who holds a license to carry a handgun issued
236236 under Subchapter H, Chapter 411, Government Code. The training may
237237 be conducted only by the commission staff or a provider approved by
238238 the commission.
239239 (b) The commission shall collect from each person who
240240 participates in the training program identifying information that
241241 includes the person's name, the person's date of birth, the license
242242 number of the license issued to the person under Subchapter H,
243243 Chapter 411, Government Code, and the address of the person's place
244244 of employment or volunteer service, as applicable.
245245 (f-1) The commission shall require each person licensed
246246 under this section to successfully complete a handgun proficiency
247247 test as prescribed by commission rule not later than August 1 of
248248 each year in order to maintain the person's license.
249249 (j) The commission shall submit the identifying information
250250 collected under Subsection (b) for each person licensed by the
251251 commission under this section to:
252252 (1) the director of the Department of Public Safety;
253253 (2) the [person's employer, if the person is employed
254254 by a] school district, open-enrollment charter school, private
255255 school, or public junior college at which the person is employed or
256256 volunteers;
257257 (3) the chief law enforcement officer of the local
258258 municipal law enforcement agency if the person is employed or
259259 volunteers at a campus of a school district, open-enrollment
260260 charter school, private school, or public junior college located
261261 within a municipality;
262262 (4) the sheriff of the county if the person is employed
263263 or volunteers at a campus of a school district, open-enrollment
264264 charter school, private school, or public junior college that is
265265 not located within a municipality; and
266266 (5) the chief administrator of any peace officer
267267 commissioned under Section 37.081 or 51.203, Education Code, if the
268268 person is employed or volunteers at a school district or public
269269 junior college that has commissioned a peace officer under either
270270 section.
271271 SECTION 7. Section 1701.260(f-1), Occupations Code, as
272272 added by this Act, applies only to a license issued or renewed under
273273 that section on or after the effective date of this Act.
274274 SECTION 8. This Act takes effect September 1, 2023.
