55 relating to judicial training requirements regarding family
66 violence.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 22.110, Government Code, is amended by
99 amending Subsections (b) and (d) and adding Subsection (d-2) to
1010 read as follows:
1111 (b) The court of criminal appeals shall adopt the rules
1212 necessary to accomplish the purposes of this section. The rules
1313 must require:
1414 (1) each district judge, judge of a statutory county
1515 court, associate judge appointed under Chapter 54A of this code or
1616 Chapter 201, Family Code, master, referee, and magistrate [to
1717 complete at least 12 hours of the training] within the judge's first
1818 term of office or the judicial officer's first four years of service
1919 to complete and provide [a method for] certification of completion
2020 of 12 hours of [that] training that include at least:
2121 (A) [. At least] four hours [of the training must
2222 be] dedicated to issues related to trafficking of persons and child
2323 abuse and neglect that cover [and must cover] at least two of the
2424 topics described in Subsections (d)(8)-(12);
2525 (B) [. At least] six hours [of the training must
2626 be] dedicated to the training described by Subsections (d)(5), (6),
2727 and (7); and
2828 (C) one hour dedicated to the training described
2929 by Subsection (d)(13);
3030 (2) [. The rules must require] each judge and judicial
3131 officer [to complete an additional five hours of training] during
3232 each additional term in office or four years of service to complete
3333 and provide certification of completion of an additional five hours
3434 of training that include at least:
3535 (A) [. At least] two hours [of the additional
3636 training must be] dedicated to the training described by
3737 Subsections (d)(11) and (12); and
3838 (B) one hour dedicated to the training described
3939 by Subsection (d)(13); and
4040 (3) each judge of a court with primary responsibility
4141 for family law or family violence matters to complete and provide
4242 certification of completion of an additional hour of training
4343 described by Subsection (d)(13) every two years [issues related to
4444 trafficking of persons and child abuse and neglect. The rules must
4545 exempt from the training requirement of this subsection each judge
4646 or judicial officer who files an affidavit stating that the judge or
4747 judicial officer does not hear any cases involving family violence,
4848 sexual assault, trafficking of persons, or child abuse and
4949 neglect].
5050 (d) The instruction must include information about:
5151 (1) statutory and case law relating to videotaping a
5252 child's testimony and relating to competency of children to
5353 testify;
5454 (2) methods for eliminating the trauma to the child
5555 caused by the court process;
5656 (3) case law, statutory law, and procedural rules
5757 relating to family violence, sexual assault, trafficking of
5858 persons, and child abuse and neglect;
5959 (4) methods for providing protection for victims of
6060 family violence, sexual assault, trafficking of persons, and child
6161 abuse and neglect;
6262 (5) available community and state resources for
6363 counseling and other aid to victims and to offenders;
6464 (6) gender bias in the judicial process;
6565 (7) dynamics and effects of being a victim of [family
6666 violence,] sexual assault, trafficking of persons, or child abuse
6767 and neglect;
6868 (8) dynamics of sexual abuse of children, including
6969 child abuse accommodation syndrome and grooming;
7070 (9) impact of substance abuse on an unborn child and on
7171 a person's ability to care for a child;
7272 (10) issues of attachment and bonding between children
7373 and caregivers;
7474 (11) issues of child development that pertain to
7575 trafficking of persons and child abuse and neglect; [and]
7676 (12) medical findings regarding physical abuse,
7777 sexual abuse, trafficking of persons, and child abuse and neglect;
7878 and
7979 (13) dynamics of family violence.
8080 (d-2) The training described by Subsection (d)(13) must be
8181 developed in consultation with a statewide family violence advocacy
8282 organization.
8383 SECTION 2. (a) Not later than December 1, 2023, the Texas
8484 Court of Criminal Appeals shall adopt the rules necessary to
8585 provide the training required under Section 22.110, Government
8686 Code, as amended by this Act.
8787 (b) Notwithstanding Section 22.110, Government Code, as
8888 amended by this Act, a judge, master, referee, or magistrate who is
8989 in office on the effective date of this Act must complete the
9090 training required by Section 22.110, Government Code, as amended by
9191 this Act, as applicable, not later than December 1, 2025.
9292 SECTION 3. This Act takes effect September 1, 2023.
