66 AN ACT
77 relating to making an appropriation for the construction,
88 operation, and maintenance of border barrier infrastructure.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. APPROPRIATION TO TRUSTEED PROGRAMS WITHIN THE
1111 OFFICE OF THE GOVERNOR. (a) The amount of $1,500,000,000 is
1212 appropriated from the general revenue fund to the Trusteed Programs
1313 within the Office of the Governor for use during the two-year period
1414 beginning on the effective date of this Act for the construction,
1515 operation, and maintenance of border barrier infrastructure.
1616 (b) The Trusteed Programs within the Office of the Governor
1717 may not contract with any known antisemitic, white supremacist, or
1818 other known hate group to construct, operate, or maintain border
1919 barrier infrastructure for which money is appropriated under
2020 Subsection (a) of this section.
2121 SECTION 2. PROHIBITION ON THE USE OF FUNDS. The money
2222 appropriated by this Act may not be used to:
2323 (a) acquire property through the exercise of eminent
2424 domain;
2525 (b) build a barrier along this state's international border
2626 with Mexico on property acquired through the exercise of eminent
2727 domain;
2828 (c) acquire property for a barrier that abuts the
2929 jurisdictional boundary between this state and another U.S. state;
3030 or
3131 (d) build a barrier that abuts the jurisdictional boundary
3232 between this state and another U.S. state.
3333 SECTION 3. EFFECTIVE DATE. This Act takes effect
3434 immediately if it receives a vote of two-thirds of all the members
3535 elected to each house, as provided by Section 39, Article III, Texas
3636 Constitution. If this Act does not receive the vote necessary for
3737 immediate effect, this Act takes effect on the 91st day after the
3838 last day of the legislative session.
