| 8 | 8 | | operation, and maintenance of border barrier infrastructure. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. APPROPRIATION TO TRUSTEED PROGRAMS WITHIN THE |
|---|
| 11 | 11 | | OFFICE OF THE GOVERNOR. (a) The amount of $1,500,000,000 is |
|---|
| 12 | 12 | | appropriated from the general revenue fund to the Trusteed Programs |
|---|
| 13 | 13 | | within the Office of the Governor for use during the two-year period |
|---|
| 14 | 14 | | beginning on the effective date of this Act for the construction, |
|---|
| 15 | 15 | | operation, and maintenance of border barrier infrastructure. |
|---|
| 16 | 16 | | (b) The Trusteed Programs within the Office of the Governor |
|---|
| 17 | 17 | | may not contract with any known antisemitic, white supremacist, or |
|---|
| 18 | 18 | | other known hate group to construct, operate, or maintain border |
|---|
| 19 | 19 | | barrier infrastructure for which money is appropriated under |
|---|
| 20 | 20 | | Subsection (a) of this section. |
|---|
| 21 | 21 | | SECTION 2. PROHIBITION ON THE USE OF FUNDS. The money |
|---|
| 22 | 22 | | appropriated by this Act may not be used to: |
|---|
| 23 | 23 | | (a) acquire property through the exercise of eminent |
|---|
| 24 | 24 | | domain; |
|---|
| 25 | 25 | | (b) build a barrier along this state's international border |
|---|
| 26 | 26 | | with Mexico on property acquired through the exercise of eminent |
|---|
| 27 | 27 | | domain; |
|---|
| 28 | 28 | | (c) acquire property for a barrier that abuts the |
|---|
| 29 | 29 | | jurisdictional boundary between this state and another U.S. state; |
|---|
| 30 | 30 | | or |
|---|
| 31 | 31 | | (d) build a barrier that abuts the jurisdictional boundary |
|---|
| 32 | 32 | | between this state and another U.S. state. |
|---|
| 33 | 33 | | SECTION 3. EFFECTIVE DATE. This Act takes effect |
|---|
| 34 | 34 | | immediately if it receives a vote of two-thirds of all the members |
|---|
| 35 | 35 | | elected to each house, as provided by Section 39, Article III, Texas |
|---|
| 36 | 36 | | Constitution. If this Act does not receive the vote necessary for |
|---|
| 37 | 37 | | immediate effect, this Act takes effect on the 91st day after the |
|---|
| 38 | 38 | | last day of the legislative session. |
