9	8		AN ACT
10	9		relating to the establishment of the sickle cell disease registry.
11	10		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12	11		SECTION 1. Subtitle B, Title 2, Health and Safety Code, is
13	12		amended by adding Chapter 52B to read as follows:
14	13		CHAPTER 52B. SICKLE CELL DISEASE REGISTRY
15	14		Sec. 52B.001. DEFINITION. In this chapter, "health care
16	15		facility" means:
17	16		(1) a hospital licensed under Chapter 241; or
18	17		(2) any other facility that provides diagnostic or
19	18		treatment services to patients with sickle cell disease.
20	19		Sec. 52B.002. REGISTRY; CONTENTS. (a) The department shall
21	20		establish and maintain a sickle cell disease registry in accordance
22	21		with this chapter for use as a single repository of accurate,
23	22		complete records of sickle cell disease cases to aid in the cure and
24	23		treatment of sickle cell disease in this state.
25	24		(b) The sickle cell disease registry must include:
26	25		(1) a record of sickle cell disease cases that occur in
27	26		this state; and
28	27		(2) any other information concerning sickle cell
29	28		disease cases the executive commissioner considers necessary and
30	29		appropriate to assist with the cure or treatment of sickle cell
31	30		disease.
32	31		Sec. 52B.003. DATA FROM HEALTH CARE FACILITIES. A health
33	32		care facility shall provide to the department, in the form and
34	33		manner the department prescribes, data the department considers
35	34		necessary and appropriate concerning sickle cell disease cases.
36	35		Sec. 52B.004. DEPARTMENT POWERS; RULES. (a) To implement
37	36		this chapter, the department may:
38	37		(1) execute necessary contracts;
39	38		(2) receive data from health care facilities
40	39		concerning sickle cell disease cases to record and analyze the data
41	40		directly related to the disease; and
42	41		(3) compile and publish statistical and other studies
43	42		derived from data obtained under this chapter to provide, in an
44	43		accessible form, information useful to physicians, other medical
45	44		personnel, and the public.
46	45		(b) The executive commissioner shall adopt rules to
47	46		implement this chapter.
48	47		(c) The executive commissioner by rule shall develop
49	48		guidelines to:
50	49		(1) obtain data from health care facilities regarding
51	50		sickle cell disease cases;
52	51		(2) protect the confidentiality of individuals
53	52		diagnosed with sickle cell disease in accordance with Section
54	53		159.002, Occupations Code; and
55	54		(3) ensure the registry is developed in a manner
56	55		consistent with:
57	56		(A) the Health Insurance Portability and
58	57		Accountability Act of 1996 (Pub. L. No. 104-191) and regulations
59	58		adopted under that Act; and
60	59		(B) other applicable laws and regulations
61	60		governing disclosure of health information.
62	61		Sec. 52B.005. REPORTS. (a) The department shall submit an
63	62		annual report to the legislature on the information obtained under
64	63		this chapter.
65	64		(b) The department, in cooperation with other sickle cell
66	65		disease reporting organizations and research institutions, may
67	66		publish reports the department determines are necessary to carry
68	67		out the purposes of this chapter.
69	68		SECTION 2. As soon as practicable after the effective date
70	69		of this Act, the executive commissioner of the Health and Human
71	70		Services Commission shall adopt rules necessary to implement
72	71		Chapter 52B, Health and Safety Code, as added by this Act.
73	72		SECTION 3. This Act takes effect September 1, 2025.
