98 AN ACT
109 relating to the establishment of the sickle cell disease registry.
1110 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1211 SECTION 1. Subtitle B, Title 2, Health and Safety Code, is
1312 amended by adding Chapter 52B to read as follows:
1413 CHAPTER 52B. SICKLE CELL DISEASE REGISTRY
1514 Sec. 52B.001. DEFINITION. In this chapter, "health care
1615 facility" means:
1716 (1) a hospital licensed under Chapter 241; or
1817 (2) any other facility that provides diagnostic or
1918 treatment services to patients with sickle cell disease.
2019 Sec. 52B.002. REGISTRY; CONTENTS. (a) The department shall
2120 establish and maintain a sickle cell disease registry in accordance
2221 with this chapter for use as a single repository of accurate,
2322 complete records of sickle cell disease cases to aid in the cure and
2423 treatment of sickle cell disease in this state.
2524 (b) The sickle cell disease registry must include:
2625 (1) a record of sickle cell disease cases that occur in
2726 this state; and
2827 (2) any other information concerning sickle cell
2928 disease cases the executive commissioner considers necessary and
3029 appropriate to assist with the cure or treatment of sickle cell
3130 disease.
3231 Sec. 52B.003. DATA FROM HEALTH CARE FACILITIES. A health
3332 care facility shall provide to the department, in the form and
3433 manner the department prescribes, data the department considers
3534 necessary and appropriate concerning sickle cell disease cases.
3635 Sec. 52B.004. DEPARTMENT POWERS; RULES. (a) To implement
3736 this chapter, the department may:
3837 (1) execute necessary contracts;
3938 (2) receive data from health care facilities
4039 concerning sickle cell disease cases to record and analyze the data
4140 directly related to the disease; and
4241 (3) compile and publish statistical and other studies
4342 derived from data obtained under this chapter to provide, in an
4443 accessible form, information useful to physicians, other medical
4544 personnel, and the public.
4645 (b) The executive commissioner shall adopt rules to
4746 implement this chapter.
4847 (c) The executive commissioner by rule shall develop
4948 guidelines to:
5049 (1) obtain data from health care facilities regarding
5150 sickle cell disease cases;
5251 (2) protect the confidentiality of individuals
5352 diagnosed with sickle cell disease in accordance with Section
5453 159.002, Occupations Code; and
5554 (3) ensure the registry is developed in a manner
5655 consistent with:
5756 (A) the Health Insurance Portability and
5857 Accountability Act of 1996 (Pub. L. No. 104-191) and regulations
5958 adopted under that Act; and
6059 (B) other applicable laws and regulations
6160 governing disclosure of health information.
6261 Sec. 52B.005. REPORTS. (a) The department shall submit an
6362 annual report to the legislature on the information obtained under
6463 this chapter.
6564 (b) The department, in cooperation with other sickle cell
6665 disease reporting organizations and research institutions, may
6766 publish reports the department determines are necessary to carry
6867 out the purposes of this chapter.
6968 SECTION 2. As soon as practicable after the effective date
7069 of this Act, the executive commissioner of the Health and Human
7170 Services Commission shall adopt rules necessary to implement
7271 Chapter 52B, Health and Safety Code, as added by this Act.
7372 SECTION 3. This Act takes effect September 1, 2025.
