11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Section 11.1272(c), Water Code, is amended to |
---|
13 | 13 | | read as follows: |
---|
14 | 14 | | (c) A [By May 1, 2005, a] drought contingency plan required |
---|
15 | 15 | | by commission rule adopted under this section must: |
---|
16 | 16 | | (1) include specific, quantified targets for water use |
---|
17 | 17 | | reductions that are: |
---|
18 | 18 | | (A) to be achieved during periods of water |
---|
19 | 19 | | shortages and drought; and |
---|
20 | 20 | | (B) established by the [. The] entity preparing |
---|
21 | 21 | | the plan; |
---|
22 | 22 | | (2) prohibit the use of water on nonresidential |
---|
23 | 23 | | property to irrigate nonfunctional turf, as defined by commission |
---|
24 | 24 | | rule, during periods of water shortages and drought; and |
---|
25 | 25 | | (3) include methods for enforcing compliance with the |
---|
26 | 26 | | prohibition described by Subdivision (2) [shall establish the |
---|
27 | 27 | | targets]. |

28 | 28 | | SECTION 2. (a) Not later than January 1, 2026, the Texas |
---|
29 | 29 | | Commission on Environmental Quality shall adopt rules necessary to |
---|
30 | 30 | | implement Section 11.1272(c), Water Code, as amended by this Act. |
---|
31 | 31 | | (b) Not later than May 1, 2026, a wholesale or retail public |
---|
32 | 32 | | water supplier or an irrigation district required to develop a |
---|
33 | 33 | | drought contingency plan under Section 11.1272, Water Code, shall |
---|
34 | 34 | | update that plan to implement Section 11.1272(c), Water Code, as |
---|
35 | 35 | | amended by this Act. |
---|
36 | 36 | | SECTION 3. This Act takes effect September 1, 2025. |
