77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a prohibition on the use of water on nonresidential
1010 property to irrigate nonfunctional turf during a drought.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 11.1272(c), Water Code, is amended to
1313 read as follows:
1414 (c) A [By May 1, 2005, a] drought contingency plan required
1515 by commission rule adopted under this section must:
1616 (1) include specific, quantified targets for water use
1717 reductions that are:
1818 (A) to be achieved during periods of water
1919 shortages and drought; and
2020 (B) established by the [. The] entity preparing
2121 the plan;
2222 (2) prohibit the use of water on nonresidential
2323 property to irrigate nonfunctional turf, as defined by commission
2424 rule, during periods of water shortages and drought; and
2525 (3) include methods for enforcing compliance with the
2626 prohibition described by Subdivision (2) [shall establish the
2727 targets].
2828 SECTION 2. (a) Not later than January 1, 2026, the Texas
2929 Commission on Environmental Quality shall adopt rules necessary to
3030 implement Section 11.1272(c), Water Code, as amended by this Act.
3131 (b) Not later than May 1, 2026, a wholesale or retail public
3232 water supplier or an irrigation district required to develop a
3333 drought contingency plan under Section 11.1272, Water Code, shall
3434 update that plan to implement Section 11.1272(c), Water Code, as
3535 amended by this Act.
3636 SECTION 3. This Act takes effect September 1, 2025.
