88 AN ACT
99 relating to artificial intelligence mental health services.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subtitle E, Title 7, Health and Safety Code, is
1212 amended by adding Chapter 616 to read as follows:
1313 CHAPTER 616. ARTIFICIAL INTELLIGENCE MENTAL HEALTH SERVICES
1414 Sec. 616.001. DEFINITIONS. In this chapter:
1515 (1) "Artificial intelligence" means computer software
1616 designed to simulate human intelligence through machine learning
1717 and perform tasks normally requiring human involvement.
1818 (2) "Artificial intelligence mental health services"
1919 means counseling, therapy, or other mental health services provided
2020 through the use of artificial intelligence.
2121 (3) "Commission" means the Health and Human Services
2222 Commission.
2323 (4) "Executive commissioner" means the executive
2424 commissioner of the commission.
2525 (5) "Licensed mental health professional" means an
2626 individual licensed by this state to provide counseling, therapy,
2727 or other mental health services, including:
2828 (A) a physician licensed under Subtitle B, Title
2929 3, Occupations Code, who specializes in psychiatry;
3030 (B) a psychologist licensed under Chapter 501,
3131 Occupations Code;
3232 (C) a marriage and family therapist licensed
3333 under Chapter 502, Occupations Code;
3434 (D) a licensed professional counselor licensed
3535 under Chapter 503, Occupations Code; and
3636 (E) a social worker licensed under Chapter 505,
3737 Occupations Code.
3838 Sec. 616.002. REQUIREMENTS FOR PROVISION OF ARTIFICIAL
3939 INTELLIGENCE MENTAL HEALTH SERVICES. (a) A person may not provide
4040 artificial intelligence mental health services to an individual in
4141 this state unless:
4242 (1) the artificial intelligence application through
4343 which the services are provided is commission-approved under
4444 Section 616.003; and
4545 (2) the person providing the services is a licensed
4646 mental health professional or a person who ensures a licensed
4747 mental health professional is available at all times to each
4848 individual receiving services through artificial intelligence.
4949 (b) The licensed mental health professional described by
5050 Subsection (a) must:
5151 (1) be available to review the progress of an
5252 individual receiving artificial intelligence mental health
5353 services;
5454 (2) be available to communicate directly as needed
5555 with the individual; and
5656 (3) intervene in the provision of the services if the
5757 individual is:
5858 (A) threatening harm to self or others; or
5959 (B) reporting abuse or neglect of a child.
6060 (c) A person who offers artificial intelligence mental
6161 health services shall:
6262 (1) clearly advise each individual who may use the
6363 services that the services are provided through artificial
6464 intelligence; and
6565 (2) obtain the individual's informed consent before
6666 the individual receives the services.
6767 Sec. 616.003. REQUIRED TESTING AND APPROVAL. (a)
6868 Notwithstanding Section 616.002, a licensed mental health
6969 professional may provide artificial intelligence mental health
7070 services only to an individual who has agreed to receive the
7171 services for purposes of testing an artificial intelligence
7272 application as indicated by the individual signing an informed
7373 consent document acknowledging the individual understands the
7474 nature of the testing and agrees to:
7575 (1) receive artificial intelligence mental health
7676 services through an application in active development that has not
7777 been demonstrated to be competent and safe; and
7878 (2) release the artificial intelligence mental health
7979 services provider from all liability associated with the artificial
8080 intelligence mental health services provided during testing.
8181 (b) An artificial intelligence application may only be
8282 considered to have successfully completed testing after the testing
8383 results demonstrate competency and safety in the application's
8484 provision of artificial intelligence mental health services.
8585 (c) Following a request for approval of an artificial
8686 intelligence application to provide mental health services, the
8787 commission shall evaluate the application's testing results and
8888 issue an order approving or disapproving the application's use in
8989 providing artificial intelligence mental health services in this
9090 state.
9191 (d) The commission shall post on its Internet website the
9292 testing results of each artificial intelligence application
9393 submitted to the commission for testing.
9494 Sec. 616.004. ETHICS AND STANDARDS FOR ARTIFICIAL
9595 INTELLIGENCE MENTAL HEALTH SERVICES. (a) A licensed mental health
9696 professional in this state who provides artificial intelligence
9797 mental health services shall be guided by the ethical principles
9898 and standards applicable in the provision of mental health services
9999 without the use of artificial intelligence.
100100 (b) A person who provides artificial intelligence mental
101101 health services may not discriminate against an individual on the
102102 basis of race, ethnicity, gender, sexual orientation, or any other
103103 characteristic.
104104 Sec. 616.005. STATE AGENCY REGULATORY AUTHORITY;
105105 DISCIPLINARY ACTION. (a) Each state agency regulating the
106106 provision of counseling, therapy, or other mental health services
107107 shall recognize as authorized by this state the artificial
108108 intelligence mental health services provided through an artificial
109109 intelligence application approved under this chapter.
110110 (b) A person providing artificial intelligence mental
111111 health services who violates an applicable provision of a
112112 professional licensing statute is subject to disciplinary action as
113113 provided by that statute regardless of whether the person is
114114 licensed under that statute.
115115 Sec. 616.006. REPORTING. A person who provides artificial
116116 intelligence mental health services shall maintain records of the
117117 person's provision of the services in the same manner as required by
118118 the applicable professional licensing statute.
119119 Sec. 616.007. RULES. The executive commissioner shall
120120 adopt rules necessary to implement this chapter.
121121 SECTION 2. This Act takes effect September 1, 2025.
