138 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
14- SECTION 1. Subchapter B, Chapter 32, Human Resources Code,
15- is amended by adding Section 32.02482 to read as follows:
16- Sec. 32.02482. MEDICAL ASSISTANCE REIMBURSEMENT FOR
17- LACTATION CONSULTATION SERVICES. (a) In this section:
18- (1) "Lactation consultant" means an individual
19- certified by an international or national certification program
20- approved by the commission to provide lactation consultation
21- services.
22- (2) "Recipient" means a medical assistance program
23- recipient.
24- (b) The commission shall ensure medical assistance
25- reimbursement is provided to a lactation consultant for providing
26- lactation consultation services to a recipient.
27- (c) The executive commissioner shall establish a separate
28- provider type for lactation consultants for purposes of enrollment
29- as a provider for and reimbursement under the medical assistance
30- program.
9+ SECTION 1. Section 32.024, Human Resources Code, is
10+ amended by amending Subsections (pp) and (qq) and by adding
11+ Subsection (rr) to read as follows:
12+ (pp) For purposes of enrollment as a provider and
13+ reimbursement under the medical assistance program, the commission
14+ shall establish a separate provider type for a community health
15+ worker who provides lactation consultation services, or case
16+ management services under the case management for children and
17+ pregnant women program under Section 531.653(4), Government Code.
18+ (qq) For purposes of enrollment as a provider and
19+ reimbursement under the medical assistance program, the commission
20+ shall establish a separate provider type for a doula who:
21+ (1) is certified by a recognized national doula
22+ certification program approved by the commission; and
23+ (2) provides lactation consultation services, or case
24+ management services under the case management for children and
25+ pregnant women program under Section 531.653(5), Government Code.
26+ (rr) The commission shall provide medical assistance
27+ coverage of lactation consultation as a separately reimbursed
28+ pregnancy related service when delivered to a recipient under the
29+ medical assistance program by an eligible provider who has a
30+ certification in lactation consultation. The executive
31+ commissioner shall establish a separate provider type for lactation
32+ consultant providers for purposes of enrollment as a provider for
33+ and reimbursement under the medical assistance program.
3134 SECTION 2. If before implementing any provision of this Act
3235 a state agency determines that a waiver or authorization from a
3336 federal agency is necessary for implementation of that provision,
3437 the agency affected by the provision shall request the waiver or
3538 authorization and may delay implementing that provision until the
3639 waiver or authorization is granted.
3740 SECTION 3. This Act takes effect September 1, 2025.
