| 8 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 11 | | SECTION 1. SECTION 1. Sec. 202.001, Property Code, is |
|---|
| 10 | 12 | | amended by adding Subdivision (6) to read as follows: |
|---|
| 11 | 13 | | (6) "Thin Blue Line flag" means a flag that is similar to the |
|---|
| 12 | 14 | | flag of the United States of America in style and design consisting |
|---|
| 13 | 15 | | of both: |
|---|
| 14 | 16 | | (A) a black rectangle in the upper hoist corner |
|---|
| 15 | 17 | | bearing fifty white five-pointed stars arranged in nine offset |
|---|
| 16 | 18 | | horizontal rows; and |
|---|
| 17 | 19 | | (B) thirteen horizontal stripes of equal height, the |
|---|
| 18 | 20 | | top and bottom stripe being black, with alternating white and black |
|---|
| 19 | 21 | | stripes in between, except that the eighth horizontal stripe from |
|---|
| 20 | 22 | | the top of the flag or emblem which appears directly below the field |
|---|
| 21 | 23 | | of stars is a blue stripe. |

| 22 | 24 | | SECTION 2. Section 202.012(a), Property Code, is amended to |

| 23 | 25 | | read as follows: |

| 24 | 26 | | Sec. 202.012. FLAG DISPLAY. (a) A property owners' |

| 25 | 27 | | association may not, except as provided in this section, adopt or |
|---|
| 26 | 28 | | enforce a dedicatory instrument provision that prohibits, |
|---|
| 27 | 29 | | restricts, or has the effect of prohibiting or restricting an owner |
|---|
| 28 | 30 | | from the display of: |
|---|
| 29 | 31 | | (1) the flag of the United States of America; |
|---|
| 30 | 32 | | (2) the flag of the State of Texas; [or] |
|---|
| 31 | 33 | | (3) an official or replica flag of any branch of the United |
|---|
| 32 | 34 | | States armed forces[.]; or |
|---|
| 33 | 35 | | (4) a Thin Blue Line flag described by Sec. 202.001(6). |

| 34 | 36 | | SECTION 3. This Act takes effect September 1, 2025. |
