57 AN ACT
68 relating to dedicatory instruments prohibiting or restricting the
79 display of Thin Blue Line flags by a property owners' association.
810 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
911 SECTION 1. SECTION 1. Sec. 202.001, Property Code, is
1012 amended by adding Subdivision (6) to read as follows:
1113 (6) "Thin Blue Line flag" means a flag that is similar to the
1214 flag of the United States of America in style and design consisting
1315 of both:
1416 (A) a black rectangle in the upper hoist corner
1517 bearing fifty white five-pointed stars arranged in nine offset
1618 horizontal rows; and
1719 (B) thirteen horizontal stripes of equal height, the
1820 top and bottom stripe being black, with alternating white and black
1921 stripes in between, except that the eighth horizontal stripe from
2022 the top of the flag or emblem which appears directly below the field
2123 of stars is a blue stripe.
2224 SECTION 2. Section 202.012(a), Property Code, is amended to
2325 read as follows:
2426 Sec. 202.012. FLAG DISPLAY. (a) A property owners'
2527 association may not, except as provided in this section, adopt or
2628 enforce a dedicatory instrument provision that prohibits,
2729 restricts, or has the effect of prohibiting or restricting an owner
2830 from the display of:
2931 (1) the flag of the United States of America;
3032 (2) the flag of the State of Texas; [or]
3133 (3) an official or replica flag of any branch of the United
3234 States armed forces[.]; or
3335 (4) a Thin Blue Line flag described by Sec. 202.001(6).
3436 SECTION 3. This Act takes effect September 1, 2025.
