By: Louderback H.B. No. 1486 A BILL TO BE ENTITLED AN ACT relating to dedicatory instruments prohibiting or restricting the display of Thin Blue Line flags by a property owners' association. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. SECTION 1. Sec. 202.001, Property Code, is amended by adding Subdivision (6) to read as follows: (6) "Thin Blue Line flag" means a flag that is similar to the flag of the United States of America in style and design consisting of both: (A) a black rectangle in the upper hoist corner bearing fifty white five-pointed stars arranged in nine offset horizontal rows; and (B) thirteen horizontal stripes of equal height, the top and bottom stripe being black, with alternating white and black stripes in between, except that the eighth horizontal stripe from the top of the flag or emblem which appears directly below the field of stars is a blue stripe. SECTION 2. Section 202.012(a), Property Code, is amended to read as follows: Sec. 202.012. FLAG DISPLAY. (a) A property owners' association may not, except as provided in this section, adopt or enforce a dedicatory instrument provision that prohibits, restricts, or has the effect of prohibiting or restricting an owner from the display of: (1) the flag of the United States of America; (2) the flag of the State of Texas; [or] (3) an official or replica flag of any branch of the United States armed forces[.]; or (4) a Thin Blue Line flag described by Sec. 202.001(6). SECTION 3. This Act takes effect September 1, 2025.
