| 8 | 8 | | relating to reporting the number of children known or reasonably |

| 9 | 9 | | believed to not be citizens of the United States enrolled in a |
|---|
| 10 | 10 | | public school and to requesting reimbursement from the United |
|---|
| 11 | 11 | | States government for the cost of educating those children. |
|---|
| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 25.001, Education Code, is amended by |
|---|
| 14 | 14 | | adding Subsections (k), (l), and (m) to read as follows: |
|---|
| 15 | 15 | | (k) A school district shall include in the district's Public |
|---|
| 16 | 16 | | Education Information Management System (PEIMS) report, in the |
|---|
| 17 | 17 | | manner and form prescribed by commissioner rule, the number of |
|---|
| 18 | 18 | | persons admitted to the district under this section whom the |
|---|
| 19 | 19 | | district knows or reasonably believes to not be citizens of the |
|---|
| 20 | 20 | | United States. Nothing in this subsection authorizes a school |
|---|
| 21 | 21 | | district to deny admission to any person who is eligible under |
|---|
| 22 | 22 | | Subsection (b). |
|---|
| 23 | 23 | | (l) The commissioner shall annually submit to the United |
|---|
| 24 | 24 | | States government a request that the United States government |
|---|
| 25 | 25 | | reimburse the state for the cost of educating the total number of |
|---|
| 26 | 26 | | persons reported under Subsection (k) by all school districts. |
|---|
| 27 | 27 | | (m) The commissioner shall adopt rules as necessary to |
|---|
| 28 | 28 | | implement Subsections (k) and (l), including rules to ensure that |
|---|
| 29 | 29 | | information reported under those subsections does not contain |
|---|
| 30 | 30 | | personally identifiable information of a student. |
|---|
| 31 | 31 | | SECTION 2. This Act applies beginning with the 2025-2026 |
|---|
| 32 | 32 | | school year. |
|---|
| 33 | 33 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 34 | 34 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 35 | 35 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 36 | 36 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 37 | 37 | | Act takes effect September 1, 2025. |
