66 A BILL TO BE ENTITLED
77 AN ACT
88 relating to reporting the number of children known or reasonably
99 believed to not be citizens of the United States enrolled in a
1010 public school and to requesting reimbursement from the United
1111 States government for the cost of educating those children.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 25.001, Education Code, is amended by
1414 adding Subsections (k), (l), and (m) to read as follows:
1515 (k) A school district shall include in the district's Public
1616 Education Information Management System (PEIMS) report, in the
1717 manner and form prescribed by commissioner rule, the number of
1818 persons admitted to the district under this section whom the
1919 district knows or reasonably believes to not be citizens of the
2020 United States. Nothing in this subsection authorizes a school
2121 district to deny admission to any person who is eligible under
2222 Subsection (b).
2323 (l) The commissioner shall annually submit to the United
2424 States government a request that the United States government
2525 reimburse the state for the cost of educating the total number of
2626 persons reported under Subsection (k) by all school districts.
2727 (m) The commissioner shall adopt rules as necessary to
2828 implement Subsections (k) and (l), including rules to ensure that
2929 information reported under those subsections does not contain
3030 personally identifiable information of a student.
3131 SECTION 2. This Act applies beginning with the 2025-2026
3232 school year.
3333 SECTION 3. This Act takes effect immediately if it receives
3434 a vote of two-thirds of all the members elected to each house, as
3535 provided by Section 39, Article III, Texas Constitution. If this
3636 Act does not receive the vote necessary for immediate effect, this
3737 Act takes effect September 1, 2025.
