By: Hickland H.B. No. 1512 A BILL TO BE ENTITLED AN ACT relating to reporting the number of children known or reasonably believed to not be citizens of the United States enrolled in a public school and to requesting reimbursement from the United States government for the cost of educating those children. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 25.001, Education Code, is amended by adding Subsections (k), (l), and (m) to read as follows: (k) A school district shall include in the district's Public Education Information Management System (PEIMS) report, in the manner and form prescribed by commissioner rule, the number of persons admitted to the district under this section whom the district knows or reasonably believes to not be citizens of the United States. Nothing in this subsection authorizes a school district to deny admission to any person who is eligible under Subsection (b). (l) The commissioner shall annually submit to the United States government a request that the United States government reimburse the state for the cost of educating the total number of persons reported under Subsection (k) by all school districts. (m) The commissioner shall adopt rules as necessary to implement Subsections (k) and (l), including rules to ensure that information reported under those subsections does not contain personally identifiable information of a student. SECTION 2. This Act applies beginning with the 2025-2026 school year. SECTION 3. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2025.
