75 A BILL TO BE ENTITLED
86 AN ACT
97 relating to the criteria considered by groundwater conservation
108 districts before granting or denying a permit or permit amendment.
119 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1210 SECTION 1. Section 36.113(d), Water Code, is amended to
1311 read as follows:
1412 (d) This subsection does not apply to the renewal of an
1513 operating permit issued under Section 36.1145. Before granting or
1614 denying a permit, or a permit amendment issued in accordance with
1715 Section 36.1146, the district shall consider whether:
1816 (1) the application conforms to the requirements
1917 prescribed by this chapter and is accompanied by the prescribed
2018 fees;
2119 (2) the proposed use of water unreasonably affects:
2220 (A) existing groundwater and surface water
2321 resources; [or]
2422 (B) existing permit holders; or
2523 (C) wells that are registered with the district
2624 and exempt from the requirement to obtain a permit under this
2725 chapter or district rules;
2826 (3) the proposed use of water is dedicated to any
2927 beneficial use;
3028 (4) the proposed use of water is consistent with the
3129 district's approved management plan;
3230 (5) if the well will be located in the Hill Country
3331 Priority Groundwater Management Area, the proposed use of water
3432 from the well is wholly or partly to provide water to a pond, lake,
3533 or reservoir to enhance the appearance of the landscape;
3634 (6) the applicant has agreed to avoid waste and
3735 achieve water conservation; and
3836 (7) the applicant has agreed that reasonable diligence
3937 will be used to protect groundwater quality and that the applicant
4038 will follow well plugging guidelines at the time of well closure.
4139 SECTION 2. This Act takes effect immediately if it receives
4240 a vote of two-thirds of all the members elected to each house, as
4341 provided by Section 39, Article III, Texas Constitution. If this
4442 Act does not receive the vote necessary for immediate effect, this
4543 Act takes effect September 1, 2025.
