9	8		AN ACT
10	9		relating to certain records of a health professional providing a
11	10		telemedicine medical service, teledentistry dental service, or
12	11		telehealth service.
13	12		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
14	13		SECTION 1. Section 111.004, Occupations Code, is amended by
15	14		adding Subsections (c) and (d) to read as follows:
16	15		(c) Each agency with regulatory authority over a health
17	16		professional providing a telemedicine medical service,
18	17		teledentistry dental service, or telehealth service shall adopt
19	18		rules necessary to standardize formats for and retention of records
20	19		related to a patient's consent to:
21	20		(1) treatment;
22	21		(2) data collection; and
23	22		(3) data sharing.
24	23		(d) Rules adopted under Subsection (c) must:
25	24		(1) as applicable, address the specific consent
26	25		documentation required for:
27	26		(A) telemedicine medical services;
28	27		(B) teledentistry dental services; or
29	28		(C) telehealth services; and
30	29		(2) include provisions, based on the appropriate
31	30		standard of care, for consent documentation in an audio-only
32	31		format.
33	32		SECTION 2. This Act takes effect September 1, 2025.
