98 AN ACT
109 relating to certain records of a health professional providing a
1110 telemedicine medical service, teledentistry dental service, or
1211 telehealth service.
1312 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1413 SECTION 1. Section 111.004, Occupations Code, is amended by
1514 adding Subsections (c) and (d) to read as follows:
1615 (c) Each agency with regulatory authority over a health
1716 professional providing a telemedicine medical service,
1817 teledentistry dental service, or telehealth service shall adopt
1918 rules necessary to standardize formats for and retention of records
2019 related to a patient's consent to:
2120 (1) treatment;
2221 (2) data collection; and
2322 (3) data sharing.
2423 (d) Rules adopted under Subsection (c) must:
2524 (1) as applicable, address the specific consent
2625 documentation required for:
2726 (A) telemedicine medical services;
2827 (B) teledentistry dental services; or
2928 (C) telehealth services; and
3029 (2) include provisions, based on the appropriate
3130 standard of care, for consent documentation in an audio-only
3231 format.
3332 SECTION 2. This Act takes effect September 1, 2025.
